BACKLOGGERS LITIGATION UPDATE

1. DoJ did make a submission on Friday pertaining to inclusion in this group those who joined after June 14th 2012. Nothing much in what they said.

The important fact is that it means that all the written submissions are in. It is now up to the judge to decide whether to grant our motion, asking him to enforce our Agreement and, if so, whether it will include all those in our group. If we are lucky, the decision will come out next week.

2. The second issue concerns the so-called class-action lawsuit. Negotiations over continuing the CIC's agreement not to commence issuing refund cheques broke down. A date has been requested for September to seek an order from the Court barring CIC from acting on s. 87.4 (which closes the files) until the litigation has run its course.
