My wife and I married recently in Vancouver, and we're in the process of sending in an outland family sponsorship immigration application to CIC in Mississauga. She is a PR citizen of Hong Kong.

Our process of sending in the immigration papers are being put on hold by the police certificate when my wife was told by the HK police that they require a letter from the Canadian Consulate General requesting for the certificate. I'm citing CIC's website below(weird, this forum does not allow me to post links).

You should apply for a Certificate of No Criminal Conviction (CNCC) in person. You will be required to provide:
- your Hong Kong identity card or valid travel document

- the original letter from the Canadian Consulate General requesting the certificate;

- the original and a photocopy of the documents proving your relationship with the Principal Applicant for the visa application if the letter from the Canadian Consulate General does not contain your name (for dependents of the Principal Applicant only);

- and the processing fees of 180$HK (Fees are subject to change)



Following the above citation, I suppose she needs the Canadian Consulate General to write her the letter requesting for the Hong Kong police certificate? If so, how can she obtain such letter from the Canadian Consulate General, just email or call or walk in to request for one?

You just have to provide the address to HK Police where they have to send your reports. HK Police dont hand over the results of criminal record to applicants. They directly post it to the relevant visa office. Based on my personal experience, HK police is the most co-operative, considerate and friendly police force. I believe you would never face any problem with them.

My wife tried to contact the HK police but they sent her back to get the letter from the Canadian Consulate General of HK. So it's kind of a catch 22.

I can't get the police certificate but I can't apply for the immigration if I don't have it.
 
I'm doing it inland so it may be different. But I was told when processing my application they'll send me a letter later to request it and my husband can use that to obtain his police cetificate from HK. :)
 
In my case when I visited the HK police HQ; probably close to Wanchai, they asked me that for what reason I want to have the Certificate of No Criminal Conviction (CNCC)? I submitted a hand written application that I have applied for Canadian Immigration and as a part of the process, they need Certificate of No Criminal Conviction (CNCC).

I was also asked about the similar letter by HK police so I rushed to the Canadian Consulate on the same day - which is not far away- They told me that they don't provide any such letter. So I documented all the things. I wrote to HK police and got there reply in a few days. I took the copy of my e-mail, their reply, copy of immigration guide and argued a bit with the clerk at HK Police Center and she let me talk to her senior. The officer was very co-operative. Though he showed me couple of formats about the demand of CNCC but I told him about the reply of Canadian Consulate representative. He heard my stance and asked for any proof of my application for Canadian Immigration. I was issued my CSQ so I showed him a copy (just for a glance). Thus my application for the Certificate of No Criminal Conviction (CNCC) was accepted. Later on the result was sent to the Canadian Consulate in London ( I believe they sent the result by regular mail - but they were delivered).



Below is the letter copied which may help you in the process:

"Dear Officer!

For Immigration to Canada as Skilled Worker, I am in need of "Certificates of No Criminal Conviction". I visited the Police Headquarter located at Arsenal Road for this purpose but I was told by the officer on duty that I need to have a demand/advise letter from relevant Embassy for this purpose. Otherwise, I could not be issued such a certificate. The second thing which I was told about is that police can not hand over the certificate to me.

But when I browsed the website for relevant Canadian Embassy I found that I am required to submit the "Certificates of No Criminal Conviction" along with my application for Visa. If I submit it later on, it may/will delay the processing of my case. I have attached the said file here along and highlighted the said wording for your kind consideration (Please see page A-5 i.e. 6/9).

Thus I will kindly request you to please enlighten me in this regard.

In addition to above concern, I also want to have this Certificate Issued to me as from my native country I may have difficulties in paying the processing fee or likewise. Having said so, I request for issuance of the Certificate so that I can submit my application for Canadian Visa and Residency"



Following is the reply which I got from the HK Police Office:

"Dear Sir/Madam,

Thank you for your enquiry for the application of the Certificate of No
Criminal Conviction (CNCC).

Although you browse on the Canadian Website saying you need to produce the
CNCC together with your application otherwise would cause a delay. However,
we have been working with the Canadian Immigration Department for a very
long time and they know you have to submit your application to them first
and then they will issue you a letter for your application for CNCC. This
is who the procedure flow. Without their letter, we are unable to accept
your CNCC application.

So go ahead to submit your VISA application to the Canadian Immigration,
they will then advise you how to apply for your CNCC.

If that's what the HK police says, then I guess the way to do it is to send in the application to CIC and we'll see from there.

Or I can notify my wife and she can try what you suggested but obviously it's seems to be a luck of the draw result than a foolproof method. Again, much thanks for your input!
 
Hi Norris, on the guide IMM 3999, under "How to obtain police certificates", I think there is a letter (Request for Police Certificates/Clearances and Authorization for Release of Information) may be helpful, did you fill out and print the letter to show the Hong Kong Police?
