Hi All

We four members of family landed in Canada as PR in 2023 and same year my son got admission in Medical(MBBS) in Russia where length of course is 6 years. His MBBS course will finish in 2029 and because of that he doesn`t meet the 730 days residency requirements in Canada. Although, he has saving account, filing tax since 2023 and getting Canada government benefits since 2023. Most likely my spouse and daughter will have Canadian citizenship in 2027 and we are happily settled in Canada.

My question is how my son PR card gets renewal without meet 730 days obligation in 2029. Can he apply for PRTD (Humanitarian and Compassionate ) ground and what would be the chance to get approval?

Generally speaking, making the decision to study outside of Canada is not considered as an H&C argument since this is a personal choice and not a situation where someone was forced to remain outside of Canada. He should certainly try applying for a PRTD under H&C once he is ready to move back to Canada. However he should be prepared for the fairly high possibility that PRTD will be refused.

What kind of government benefits is he receiving? He needs to be careful since many / most of those require an individual to be living in Canada.

Would add that it will be extremely difficult to reenter the Canadian residency program with his degree from Russia. May become slightly easier as Canada tries to train more MDs but expect that to be primary limited to specialties like GPs. As already pointed out he should not be receiving any benefits and should be filing as a non-resident.
