13.3. No common-law relationship or conjugal partner relationship
If a couple is unable to cohabit and/or unable to provide satisfactory evidence of a conjugal
relationship (see Recognition of a common-law relationship, Section 5.34 above, and What is a
conjugal partner, Section 5.45 above), the application should be refused.

5.34. Recognition of a common-law relationship
A common-law relationship is fact-based and exists from the day in which two individuals
demonstrate that the relationship exists on the basis of the facts. The onus is on the applicants to
prove that they are in a conjugal relationship and that they are cohabiting, having so cohabited for
a period of at least one year, when the application is received at CPC-M.
A common-law relationship is legally a de facto relationship, meaning that it must be established
in each individual case, on the facts. This is in contrast to a marriage, which is legally a de jure
relationship, meaning that it has been established in law.

I have the same case with Filipina... the only difference is that, we are in the same sex.. My gf and I have been together or have been dating for 8 years already. In the Philippines, since same sex relationship is prohibited, hence our relation has been kept secret even up to now. So when I applied for my PR visa, I didnt declare her since I dont know if i could consider her as conjugal partner or a common law partner because we are acting only as girlfriends... Now, my problem, what will i do to sponsor her? Having her as gf, wouldn't the visa officer consider our relationship as conjugal partner and I failed to put her on the application?
I dont know what to do, I just wanted her to be with me.. So do you guys haves ome inputs to enlightenme..
By the way, we were living then in the same dormitory for students but different rooms... could this be consider conjugal or common law? Please help..thank you...

Students living in separate rooms on the same dorm can not be considered common law. Common law would have been living together in the same apartment as a couple which in most cases means you are sleeping in the same room and in the same bed. You would have to have been living like that for at least 12 months before you applied for PR or reached 12 months before you landed in order for her to have been your common law partner. It is actually great if you didn't qualify because if you had qualified before you landed as a PR, you would be in really deep trouble for not including her.

You do however have a good chance to sponsor her as your conjugal partner.
 
Thanks for the reply Leon...we are not students actually, we're both employed already..and it so happened that we were living in the students dormitory of which we both have each others room and Yeah, sometimes we slept together as girlfriends in my room.. So what about if I applied her as a conjugal partner, dont u think the VISA Officer would raise question why I haven't declared her in the first place on my VISA application? So if I applied for a conjugal partner, do I really need to tell the truth to the VISA OFFICER that we've started dating 8 years ago..wouldn't it will raise question why I didnt put her on my application? or il just tell the VO that Iv meet her just right after my landing here in Canada, to erase Whatever queries in her mind..
By the way,what is the difference between girlfruends and conjugal partner? thank you again for taking time of my problem..

It is not possible to declare a conjugal partner on your PR application. You can only apply together with a partner who is married to you or a common law partner. You can however sponsor a conjugal partner after you get your PR.

Therefore, if you did not live together as a couple for 12 months before you applied for PR or reach that point before you landed, you did not have the right to include her on your application. You can say that you started dating 8 years ago. That you lived in the same dorm as students but not in the same room etc. Just tell the truth.

But Leon, If I'm not mistaken,I think conjugal partner was also being asked during the application, it's not only the common law or spouse...I think there is also a question there in the form "do u have a conjugal partner?"...I dont know, perhaps I forgot it already... But if that is the case, then I would be very happy...☺..So what do u think Leon, can I get her now thru conjugal partner? wouldnt it entail a risk on my part?...Thanks again for enlightening me

I am not aware of any such question. At least it is not on the IMM0008. They only ask about your current marital status and conjugal is not an option there and they ask if you were previously married or in a common law relationship.

I think I already said that you have a good chance to sponsor her as a conjugal. Why would there be a risk on your part? You have not done anything wrong.
