Hello,

I am looking for information related to Canadian immigration for professionals. Currently, I am living in the U.S for the past 10 years. I have a bachelors in Industrial Engineering from India and a masters in Industrial Engineering from a U.S. university. I have been working full-time as an Industrial Engineer for over 7 years now with a H1B work visa. I am married and my wife (H4 visa) is a Chartered Accountant from India and a Certified Public Accountant from the U.S - currently looking for employment for the last 3 years (H1B visa is such a tease). I am past the second stage (approved I140 - awaiting priority date to become current) of Green Card application but slowly losing faith in the U.S. immigration system.

We would like to work and live in Canada permanently.
Where do we start - work permit or PR?
Which province and under what category should we apply for work permit/PR?
Should we apply for jobs and go through the employer for work permit/PR?

I am not so knowledgable in the work permit process, but I guess you will need an employer to process that. Considering your work experience you may want to check out the Federal skilled workers category.

Is an employment offer absolutely necessary for FSW?

I don't see Industrial Engineering in the FSW program list for 2014. But I do see Financial Auditor and Accountant in the list, which is what my spouse worked as for 2-3 years in the last 10 years.

The applications for FSW 2014 program start on May 1st. We just started looking at Canada for immigration. We have not taken IELTS tests yet. Is it too late to start the process now?

1. NO employement letter is not must for FWS;however it is a different category under FSW
2. If your wife's profession falls under occupation list, then make her principle applicant and start your application.
3. Better take IELTS ASAP, coz sometimes it gets hard to get closest date, depending on your location.
4. Don't worry you are not at all late. It is opening on may 1st, 25000 applications are there. If we consider minimum 300 application for financial auditor and accountant, you still will have bright chances to apply.

If my wife gets an employment offer, and we apply for FSW 2014 along with the employment offer, is her application counted against the cap? I'm trying to understand if we are too late to make the cut this time. Your thoughts?

FSW has further 3 categories
1. Eligible occupation- under which ur wife's occupation falls
2. Arranged employment- A permanent job is Offered by the employer and this job letter is issued on the basis of positive LMO obtained by humar resource department.
3. Phd students
Now if you want to apply under arranged employment then make sure the job offer which ur wife is getting is issued on basis of lmo. Only emoloyer can get lMO and it takes around 3-4 months for that.
If you know any employer here in Canada who can get you a job letter on basis of lmo, then it's worth waiting,as there is no cap for applications with job letter. But if you hsve to search and employer then he will apply for lmo and all, then i would suggest better go with eligible occupation category.

Thanks again. Is there a need to hire an attorney or immigration consultant for the process of application? I think I have a fairly good idea about what documents are needed, what steps are to be followed but is it worth paying $$ to someone to guide us through the process?

For settlement funds, is there a need for transaction statements or is a certified letter from a bank valid?

What would be your estimate of points for,

This is the answer to all your questions. You can go to this link and can check what documents you required, settlement funds and all. settlement fund for 2 person is $14,720
1.english- you will easily get more than 20. but lets take 20
2. age- 12
3.experince- 11
4.education- not sure could be 22 or 23. depending on WES report. Lets take 22 for assumption
5.arranged employement-0
6. adaptability -5
total -70/100 (this we have calculated by assuming minimum score) you are good to go :)
you can easily get 28/28 in IELTS

hiring a consultant or as we say in immigration terms"use of representative" is entirely an applicant's choice. Most of the applicants do this by their own, because proper instruction guide is provided and forms & documents are also not very complicated;one can easily get them done.
However those who have hectic schedules or they don't have time to get things done or could be any reason, hire a consultant for them. It's entirely an individual's choice.

I have question about the country of issue of my passport. I have a passport issued by India which was renewed prior to expiration date by Indian embassy in Chicago last year. So my new Indian passport is renewed in the US. In the passport bio page, place of issue is listed as Chicago. In the General Application form what should I answer for the question "Country of Issue"? Should I say India or USA.

Because you have to apply on basis of new passport, so the country of issue will be US. However just for safe side you can contact CIC helpline. Or may be if someone else had same issue could guide you more about this.
