My understanding is that you will, by then, have used up all of your TFW eligibility, so another WP would not be approved, regardless of a positive LMIA. I guess it depends on whether you are a low-wage or high-wage case.

It's no longer based on "Skill Level" but on the wage for that particular position. If the pay is below the provincial median, it's counted as a low-wage job. See http://www.esdc.gc.ca/eng/jobs/foreign_workers/reform/restrict.shtml

Hi guys. I'm a bit worried about this. My work permit is due to expire in April 2015 which makes me 2 years temporarily working in Canada as NOC B. Now that they changed it to 2 years maximum, has anyone read anything if a person can apply again for another 2 years of working if he cannot apply for PR. Or does it mean i can only work now until April 2015?marking my 2 years.

I think you might not be able to get a new work permit because you have already worked as a TFW for 2 years, also your workplace should have only 30% TFWs by that time. You should look into ways of getting permanent residence.

the new timeframe is applicable for those newcomers..it depends in your employer if he/she apply for LMIA 1000$ just to renew ur working permit...

Hi,

the two years maximum duration is only for those who fall under the low wage,so everyone who makes the median or above wage in their province will not be affected by this.
also it will come into force coming summer 2015,so anyone who spent two years or more working under the low wage category will be affected no matter when they entered canada.
it really does not look good anymore for a lot of TFW willing to seek employment in canada or hoping to remain here and seek permanent residence,the rules become so tight but unfortunately they are needed for the most part.

Hi,

people under high wage category are most likely those with NOC A and 0 which has no limit for how long a TFW can work in canada as long as they can find an employer willing to get an LMIA for them.

Iv been in Canada almost a years and I wanted to apply for Perm Res under AINP. I cant apply till 2016 because I must wait my turn to be nominated. Will I be able to extend my TFV to another 2 years after this. Please help.

How I wish this to be truth...still... here is our case. My husband is a truck driver in oil service and will apply for AINP next week. His wage is above median but NOC is "C" 2 years work permit will expire in January 2015 and we already have an approved LMO to extend his work permit.
According to esdc.gc.ca (can`t post link yet ) You (the employer) may be allowed to hire temporary foreign workers for a maximum of 24 months through the Stream for Lower-skilled Occupations when there is a demonstrable shortage of Canadian citizens and permanent residents.

In Canada, lower levels of formal training are defined as occupations that usually require at most a high school diploma or a maximum of 2 years of job-specific training according to the NOC Classification system. These occupations are coded at the NOC C or D skill level.

So, what really prevail in our case? High wage or NOC code?

The Temporary Foreign Worker Program (TFWP) will now be administered based on wage instead of the National Occupational Classification (NOC). Wage is a more objective and accurate reflection of skill level and labour need in a given area.

Basihan na ngayon ang sahod, if above median high skilled, pag below sa median low skilled.
