Hi all!

So the FBI clearance with the new forms now does not get sent upfront. We have the clearance issued Aug 05, 2016. By the old rules, it would expire on Feb 05, 2017 (6 months after issue date). But the guide now says:

If you need a police certificate from a country or territory and:

-are currently living there, or received the police certificate before leaving, the police certificate must be issued within six months before you apply.
-have lived there in the past, the police certificate must be issued after you last lived in that country or territory.


So, since my husband has been in Canada with me since June 06, 2016 (2 months before the clearance was issued), and will not be returning to the US while the application is processing, even if they don't ask for the FBI Clearance until after Feb 5, that one will still be valid to send, right?

This is what it sounds like to me, but I just want to make sure we don't have to send away for another one like RIGHT NOW. Should have always been like that, if you ask me--how could he get an FBI criminal record, if he hasn't even been in the US to do anything illegal since the clearance was issued? I think they've finally seen the logic here :)
But just to ease my worry, can I get some affirmation about this from a few kind souls?

Just for clarification one does not have to be physically in the US to commit a crime or show up on the FBI radar. Also due to ongoing investigations someone may become a person of interest or wanted months or even years after the crime as the investigation unfolds.

only too true as there seems to be more and more cases in the press of the FBI going after cyber crimes committed from other countries, hacking in particular or even money laundering.

This isn't actually new. These have been the PCC rules for awhile now.

His FBI PCC will remain valid unless he returns to the US.
