So, I'm back, I'm the German mum with a 4 year old child, who moved from Canada BC back to Germany in Dec 2012.
My common law partner broke up with me before. Now he is trying to get sole custody for her in Canada and try to force her back.

I had a common law open work permit. (common law partner to a skilled worker, to him)

SO: I WOULD NEED THE INFORMATION IF THE COMMON LAW OPEN WORK PERMIT IS STILL VALID??

IS THERE ANY WEBSIDE/HOMEPAGE WHERE THIS CASE IS STATED WHEN THERE ARE CHANGES? I WOULD NEED SOMETHING WRITTEN.

THE CIC Centre just provide phone statements or written which would take around a months. I don't have that time.
An immigration lawyer would need time as well.

I know it's a bit out of the topic, my apoligize, but I know here are knowledge people who can help!

Technically, your work permit is probably still valid until the expiry date.

However, using a work permit that was gained based on a common law partnership after you have split up, would be dodgy to say the least. Possibly bordering on misrepresentation.

Kind of like a student who gets an off campus work permit would not be allowed to continue working on it if they quit their studies even if the expiry date says it's still valid.

Have you talked to the Canadian embassy where you are?

thanks again for your reply.

I've spoken with an immigration lawyer and with CIC.

They stated with the next examination (eg re-enter to Canada) it will be replaced to a visitor status.

But my family Laywer in Canada said I need till Fri something written for the court proceedings. Even it is just an statement at a webside...
It has to be sth written.
I won't get this in time from the CIC or immigration lawyer, I asked already.

YOU KNOW ANY WEBSIDE WHERE IT"S STATED THAT IT WILL LOSE THE VALIDY WHEN THERE IS NO COMMON LAW ANYMORE?

I have not found anything. You could also try Service Canada and CBSA and see if you can find anybody who is willing to give you a written statement or point you to the right website.
