I am excluded from Canada for one year. My German common-law wife (PR) is there with our one-year old son. She can't get a visa to the US (I'm a US citizen) because they think she'll stay. We've applied for authorization to return to Canada and are waiting. We're filling out the common-law sponsorship. Any advice?

I haven't seen my kid in four months, except on Skype - he's started walking. It's awful and I just want to be with my family.

Is there some point at which I can visit during the application process?
Is there any way to get compassionate assistance - she's on her own and needs me. It just seems awful to separate a family.


All help appreciated.

Why don't you marry her....if you love her and have a baby with her then she will be allowed to enter the US because she is your wife. Just sayin...

And how would that happen? He can't enter Canada for a year, she can't enter the US. It would have to be 3rd country. The OP needs an Authorization to Return to Canada, depending on the reason why he was removed, it may or not be granted. As there is no application in process (the OP didn't mention) it is unlikely that the ARC would be given.
 
Marry in Germany and do a direct consular filing (DCF) at the American embassy in Germany. DCFs for an Amercian permanent residency application go fairly quickly (friends in Sweden had to wait about two months). Be upfront with the embassy about your situation and they may be able to help.

Best of luck. I think this might be your best bet.
 
thanks for help. We are applying for PR as common-law - I sent my forms and she will send in the package in a few weeks.

Regarding letters certifying our relationship - do those need to be notarized?

No they dont ..they have to be in English or French thats all...you can notarize them if u like but like I said its not mandatory.
 
We didn't get ours notarized. Good luck with your application :)
