Hello,

I am on work permit till august 2016. My wife came to canada in mid december 2015 on visitor status. She had multiple entry visa valid till 2020.

I applied for spouse open work permit in late december 2015 but it was refused yesterday because I didnt upload my employment letter, payslips, T4 etc. The mail that she received yesterday also mentioned that her visitor status expires, the same day i.e. 11 march 2016.

Now I have 90 days to apply for restoration for her status. Secondly I have received ITA in Feb 2016 and I have collected almost all the documents and was planning to submit all documents for express entry by the next weekend.

My questions are-
1) how is my wife status expiry in Canada going to affect PR application?
2) When I will apply for restoration of status for my wife, I am planning to apply for visitor now. Should I apply less 6 months or more than 6 months? I am thinking less than 6 months as I have less than 6 months left on my work permit? Please advise?
3) My wife has multiple entry visa till 2020? She is in Canada now. Do I need to apply for restoration of status or just can do the flagpoling?

1) This should have no impact on your application.
2) I would ask for six months.
3) You are supposed to be in status in order to flagpole. It's possible the CBSA official may still allow your wife to do it. Or it's possible she may have issues re-entering. Better to remain in Canada and apply for restoration.
