Ohh that's sad to know. I ask a consultant she said it's fine if the case was dismissed more than 10 years then his considered rehabilitated so no worries.

Hi i just want to ask, im in the same case my nbi marked "No criminal record" just recently vo requested add docs of nbi cert, case documents. I did submit all the essential documents however only today i reviewed my application and i did tic "no" on question if you ever been convicted to crime, recently charged, or commited to any crime. I have been charged last 2011 but case was Dismissed, now i am worried that it might be ground for refusal since it was undeclare because of my answer?

Hi based on my recent experience my nbi marked "no criminal record" since i have a dismissed case last 2011. cic requested me to submit nbi certificate from nbi main manila;however, you need to wait for their request letter in order for nbi main to entertain you. What i can recommend you now is to gather all case documents, and let the notarized everything, you can collect all this from the court where they file the case. I think all these documents are essential in order for cic to to continue processing your application. Also stated from my recent email from cic that failure to provide all these might be ground to refusal.. I hope this help!!

I got approved for an Open Working Permit even I have the No Criminal Record Found in my NBI Clearance. I'm here now in Canada and now processing our Permanent Residency and I'm worried that this will cause delays to get our PR.

When you say non-accompanying, hindi ba sya part ng application mo? Or hindi mo lang sya makakasama sa pagpunta sa Canada? Kung di ka naman magpapasa ng requirements nya like NBI Clearance definitely hindi makakaapekto sa application mo. If ever man part siya ng application requirements na isusubmit mo, as long as you will provide what IRCC needs for the NBI remark (case documents,letter of explanation from NBI),wala magiging problem. However due to Covid situation,magkakaron application mo ng delay as you still need to get the letter of explanation from NBI. Hope this helps.

Thanks po for the reply. Bale hindi pa lang po sya makakasama ngayon. And un po kasi pathway ko required na ideclare husband and children.

Have you tried to check and ask each regional trial court of the city if they have the case on record? That's what I did but in my case I contacted each Metropolitan trial court of the city and ask if they have my case on record. It's just a violation of an ordinance but since the penalty was not paid, it went to a Metro. Trial Court. I was able to secure only docket notes since the violation occurred 20+ yrs ago but I believe that's something you can get as well as a start.

That's really a problem in our current system as it also happened to me wherein the case filed against me only reflected in my NBI record only after 17+ years and that's the only time I found out about the case and where it was filed. I guess the same thing will happen to your husband as well and you guys will only know the details of the case once it reflects on his NBI record. Btw, are you guys sure that there's really a case filed against your husband that went to a trial court? If it's just a blotter and it was dropped then I don't think it's not considered a case.

Thanks for your reply.It has a case no and he went through a hearing.But his nbi says no derogatory record bec it was dismissed 2005.However since i declared it CIC os asking for court documents and police blotter which I had a hard time securing for one.The police station and trial court cant issue a copy of the blotter and resolution of the case respectively because they doNt have it on the computer yet.They said the blotter is written in a record book which is really hard to retrieve dahil napailaliman na sa mga files same as the resolution.Im not sure if they're just too lazy to retrieve or they need "padulas/lagay" before they dig in to the files...and we're in the province and its really hard to process things in manila bec of the restrictions in place right now.
