My PR application has been refused!! HLEP plz!!

Hello,

My application has been rejected and the reason is my point of view is not TRUE. This a copy os the letter

Immigration, Refugees and Citizenship Canada (IRCC) invited you to apply for permanent resident status based on the qualifications you claimed in your Express Entry profile. In your Express Entry profile you indicated that you were employed with XXX University as an “exam invigilator, post-secondary institution” for the following periods: 2016-12 to 2017-04 (20hrs/week), 2017-09 to 2017-12 (15hrs/week), and 2018-01 to 2018-04 (10hrs/week). As evidence of this employment you have submitted a letter dated 2019-04-05 from XXX University Human Resources that provides a breakdown of your contracts. The TOTAL hours worked for each period listed above are 60.75, 19, and 4.75 respectfully. This is a total of 84.5 hours worked for XXX University in the periods above. As per Ministerial Instructions (MI) respecting the Express Entry system section 15(3)(a) states that Canadian work experience is work experience that “consists of full-time work experience, or the full-time equivalent for part-time work experience, with one or more employers”. Full-time work is defined as per section 15(5) “For the purposes of this section, full-time work consists of at least 30 hours of work per week.” According to the letter from XXX University it appears that you have approximately 3 weeks of full-time equivalent work experience with them. In your application you were awarded points for 2 years of Canadian work experience that you claimed, with this change in employment duration you no longer have 2 years of Canadian work experience and this reduces your Comprehensive Ranking Score points.

Back story, I am a community nurse with a casual contract, I was already 2424h at the time when I submitted my application. The exam invigilator, post-secondary institution job the contracted why a part-time and I did send my stub with it. So the information was correct!!. I am confused and need help and guidance.

  • 5 months (~20 weeks) at 20 hours a week from 2016-12 to 2017-4, at a total of ~400 hours
  • 4 months (~16 weeks) at 15 hours a week from 2017-9 to 2017-12, at a total of ~225 hours
  • 4 months (~16 weeks) at 10 hours per week from 2018-01 to 2018-04, at a total of ~160 hours.
However, the employment letter you submitted from the university said you worked a total of 84.5 hours for them from 2016-2018.

Your profile was given points for Canadian work experience, and when the visa officer removed the university experience, you no longer had 2 years of Canadian work experience.

If you only worked 84.5 hours for the university, you should not have claimed to have worked about 600.

Thank you for replying 2 me. I did not claimed that i worked that much hours. I only worked in at the exam period which was 2 week in Apr and Dec, However my contracted was a s listed. In my reference letter that I submitted supported that and pointed out how much hours I worked at the University. I understand that after him removing this point I still have 224h work in 1 year and 7 month?. I should have not dropped that much. My point was 468!. How much did i dropped that i wasn't qualified for the PR!!

Do you have 104 separate weeks of work experience in Canada where you worked at least 30 hours each week?

Yes I work as Community nurse which is Class A. and the time of applying I had 1560h. When I accept the invitation i had 2424h in casual contract for 1 year and 7 month.

2,424 hours at 30 hours a week is 80 weeks, which is less than 2 years.

You had points for 2 years of work experience. When they removed the amount of work experience you claimed from the university, you lost points for two years of work experience.

I have no idea what your points decreased to, but they decreased far enough that you were removed.

You have to submit a new Express Entry profile and hope you receive ITA again.

Thank you. One more question what does this paragraph means ;
The decision communicated in this letter constitutes the definitive and final decision on your present application. Your application will be retained, under current Government of Canada file retention guidelines, for a period of two years. Your application forms and supporting documents will not be returned to you. If you should submit a new application it would require new fees and documentation and would need to meet all the requirements in effect at the time the application is submitted.

You would have lost 13 points, I believe. What was the cut off at the time you received ITA?

It means they will keep the details of your application in their computers for 2 years.

So if you claimed 2 years of work experience, and they could only verify 1 year, you lost 13 points in the CRS if you applied as a single person.

You said your initial points level was 468, that put you at 455.

As the current CRS cutoff is ~470, you will need to increase your points to get a new invitation.
