Hi Everyone,

I would like to ask few questions. Here's the situation...
I am planning to apply for MPNP Family Stream - First Cousin but I have an overstay record in the US. I was not deported and have no criminal record or violation. I was in transit visa before I overstayed. I was there from July 2003 to February 2006. Through the self-assessment form I can say that I am qualified and have a score of 76 pts. But I am very worried because of this situation.

1. Will this affect my application? Will my application be denied because of this?
2. Do I have to declare it? or just hide it? ( I am afraid if they find out they will automatically deny my application)
3. If I will fill up the application soon (Form IMM 5669) Background declaration, what shall I put on the "status in country" part?

I hope someone can enlighten me.

Thank you.

1. It shouldn't affect your application provided you are honest about your overstay. If you lied about your overstay, expect your application to be impacted.
2. You must declare the overstay.
3. No status / out of status

We have the same situation. I asked it already to a canadian immigration lawyer. It will not affect your application. Be honest. Declare it if they ask you. But you need to go back to your home country then apply there. That is the lawyer told me. Dont worry bro

Yes - they will most likely find out. Canada and the US share records extensively.

If you fail to declare it and CIC finds out, your application will be refused and you'll be banned from Canada for 2 years due to misrepresentation.

Thanks so much Scylla. All your responses are very helpful to my upcoming decision once nominated (I hope and pray). :)
