Hello again,
We are almost done with our paper work, we manage to get a letter of employment from one employer, but another one hasn't respond to emails & calls, we are really surprised cause my husband relationship with them was really good. They didn't even gave him a copy of his contract, it is a one month full time and the only thing we have is his taxes, NOA and payslips, also the emails requesting the letter and contract. His other job was from January 7 to December 10th so he is missing that month from the other company.
What should we do, we do have a letter of explanation and all the papers I said before, but no letter of employment.
What are your suggestions?
 
Is he employed now? maybe he can gain that one month now before applying through CEC.
If this is not an option, then you can go ahead and submit the application with what you have plus a cover letter explaining the situation. As you said you have pay slips and tax docs and also the emails showing you requested the employment letter, you should be good.

Thank you very much for your response, No, he is not employed atm, our wp expires in 2 months and ofc nobody wants to hire us :/
I will keep trying to see if they can send it but if not I will just send the papers like that and hope everything goes fine :D

Try to obtain the letter from that work place at all costs. If you send papers just as they are most chances you will be rejected - one thing you can do is to include letter of explanation and provide copy of emails/letters sent to the employer requesting the employment letter...

We have done everything we can, we are still pushing the matter, still there is just silence about this. We do have what you said, the emails, letter of explanation , payment slips, NOA and Tax return with the T4. Also we are including their contact information, maybe they will answer them since they definitely don;t want to talk to us. I am wondering why some employers do this, I called CIC for help and it seems like they actually have no idea what are they doing, it was frustrating dealing with this people.

I feel like employees should be able to sue companies for this. This lackadaisical attitude on the path of the employers is so annoying. One spend years making the company money and they wont give you just a piece of paper that is not gonna hurt anyone. Its not like you're asking for a raise.

Some employers may not want to issue it as they know they underpay.

1. Your ROE and your T4 only showed you worked, it doesn't show your job duties. So how could CIC make a decision that you performed the duties claimed in the NOC?
 
Thank you very much for your awesome responses, It took a little bit of convincing and sending emails to other people rather than HR to get their help. We finally got the letters!!! We are so happy, now we have a question... the list ask for copies of the letters, I was told they will ask for the originals later, is that right?
If so, then I suppose we are done, we just need to go to get our new common law form since the last one was from 2012 and we were told that it's better to get a more recent one.
After that is done we are ready to go to the bank, make the payment with the Fees Receipt (IMM 5401) I asked for a couple of months ago and send the papers :)

Sad to see their(employer's) behavior for issuing the letter.
Most of the members are correct in saying that, do not apply if you do not have the letter, as I did the same when I submitted my PR for the first time, employer refused to give me the letter, so I attached, Pay Slips, T4's, NOA, Bank Statements, Performance review letter, Promotion letters, affidavits from my colleagues that I perform those duties, as well as an explanation letter stating why I couldn't submit the letter.
Yet, after 8 months, I got a refusal from CIC, that they couldn't give me the PR, because they were not satisfied with whatever I had submitted.

So, my advise, based on personal experience is do not apply with out it.
However, if your family really wants to pursue PR at this moment and since your WP is expiring in 2months.. My recommendation, would be to apply the PR with all the supporting documents you guys have, most probably you will get AOR, with in 6 -7 weeks and file for BOWP.
Hopefully, you get it before ur WP expires and then search for employment, gain experience and get the letter and if ur PR is rejected , apply again.

Yes, you send photocopies of the letters, you keep the originals. CIC may or may not ask to see them, but you need to keep them just in case...

I am in same situation like you. But I submitted for PR application with similar set of documents you mentioned above.Only difference in my case could be I am on a deputation from India to Canada. As the Canadian branch did not issue me the requested letter I submitted a letter from Indian Branch. I received my AOR, MR & RPRF. Couple of weeks back I received a request for Hong kong PCC. I am Current waiting for this. Based on the current status of my application I am only hoping that I am eligibility passed, but I don't know for sure. I applied for GCMS notes which I will get on the 2nd of May.
