Finding a sub-tenant is subject to the landlord's approval; he or she doesn't want a destructive person in the apartment.

Usually the deposit is forfeited as the price of breaking the contract. Theoretically the landlord could sue you in small claims court for the missing rent, but few would take the time.

The best option would be to discuss this with the landlord in advance, giving him time to find a replacement tenant to his taste. Or you could offer to look for him. A reasonable landlord might so appreciate your honesty that he might return your deposit anyway. If not, don't pay your last month's rent, and say that the deposit covers it. This might ruin your credit rating if the landlord reports you to the credit bureau.
