Very strange. This is what I was told

You can request a copy of the decision on his refugee claim to the IRB office of the city where the claimed was heard.

Yes thats my plan. I am going to write it send it to him have him print and sign it and attempt to fax it from somewhere in mexico.
They said it had to be his signature and that the signature had to match the one they have on file for him. He said if I wanted the papers sent to me that my husband had to write that in the letter and they would do it. He said it would go out by regular mail. I asked him how long it would take and he told me he couldnt say. So I said are we talking months or weeks and he said weeks.

From what i go in the call he said to state the following

- Request a copy of the refugee decision and reasons

- Date of birth

- Name

- Signature

- Mailing address and both (husband and me also clearly say to send the paperowork to my address) contact phone numbers (both of us)

- Client ID number (if we dont have that then the date my husband arrived/left)


I am going to call again tomorrow to see if I get someone else and they confirm the same details. i will keep you posted.

This happened to my husband's brother. He went to the the SSP and because there were "hominimos" or people with his same name, they had to do a complete check, hence the 10-day timeframe.

Not sure if a friend can pick it up. I think it needs to be a relative that has the same surname(s) as you. That was the case for my husband. He initially sent his nephew, but because they did not share the same surnames, he couldn't pick it up. He ended up sending my brother-in-law(my hubby's brother).

Well after three years it's kinda late for that lol. The only thing that could happen is that they deny my ARC, which seems very unlikely given what I've read on this forum. I also refuse to believe my luck is that bad.

After winning my sponsorship appeal, redoing medical exams and handing in all my police certificates, I'm 100% that this is the last thing I need. I already submitted my ARC, so now I just gotta wait.

Thta's what i thought too but I asked the guy what happened if I couldn't pick it up myself and he said as long as that person had a carta poder signed by me they could pick it up so lets see.

I have a big update for you. So many ups and downs this morning.
Oh also to answer your question there is no fee associated with this.

So I called again to confirm the details the man gave me yesterday.

This time I had a woman. She asked me for my husband's client ID number. I told her I didn't have it but I have his UCI number (from our sponsor papers) she said she could use that number to pull up his history. So she then gave me his “File #” which was 2 letters followed by 6 digits.

Anyways she said because his refugee claim was from 2005 the file has been destroyed. I had a heart attack and literally almost cried. I was like OMG what am I supposed to do now I freaked out so she said she transferred me to the woman who was assigned to his case. So I spoke with her and she said his files were at the national archive which just means it takes 2 business days longer to access his files. I told her the other woman told me they were destroyed and she said that wasn't true. So I am very nervous now and I hope they are not because I could tell the woman was reading write from her screen when I hear her say file destroyed.

So this woman confirmed the same details. She said my husband needs to write a letter with all his info and say he fully grants access to his wife to get this information and that the only way to send it is by fax and the only way they respond is by regular mail. She told me 2 weeks to receive it.

So fingers crossed!! I'm on pins and needles. If they destroyed his file from 2005 that's crazy that's not even that long ago. I hope all goes well when you call BC let me know!

Chuladaa! Don't worry about the "its destroyed" comment.
By law immigration has to keep all files for I think up to 30 years after someone dies.

Even on the website it says you can obtain files from people from before 1936 or at least 20 years after they die.

Its the law they need to keep all files. So don't worry about that!!

Even my dads company, he has 2 companies and he has to keep files up to 7 years old by law. I'm sure immigration is much more strict. Lol.

So they definatly have it! :D
