May a child of a sponsored person study in Canada?

The situation is as this:

A lady with a child are in Canada visiting her boyfriend. They decide to marry and she will stay with the kid in Canada. The Boyfriend will apply for sponsoring her and the child under the 'spouse in-Canada Class"

The child is 12 years old and he has not custody problems.

May the child study in Canada while the applications is processed?

If you mean, can the child go to school, the answer is, from what I am seeing in other posts, Yes. The Canadian spouse should take the child to the school for local area and enroll the child there. I am given to understand that they don't really check to see if the child is a citizen or a PR. Just make sure that said 'boyfriend' is now said spouse and step parent to that child legally.

Yes that's is what I meant.

The law says that only dependents with a parent with a Study Permit or Working Permit may study in Canada without a 'Study Permit"

That's the reason why I asked.

The 'studying' part is more meant for college/university, not grammer school :D

...and if you become the childs step parent by marrying his mother, than you are a parent that is allowed to study/work in Canada, yes? ;)

It is up to the individual school or school board. Some will require proof of the parent's work or study permit and not allow a child to enroll without it (regardless of a Canadian step-parent). Other schools won't ask for proof of either the parent's or the child's status.

That is pretty much why I stated if the Canadian citizen step parent enrolls the child, less questions are likely to be asked. Nothing is for sure, by a long shot, but a lot of the folks here have managed to successfully enroll their children in school.

Yes, quite have a few have managed to successfully enroll their kids regardless of status but I wanted to make the OP aware that some have not, even with a Canadian step-parent.

Agreed. Based on the stories here - it's hit and miss. Some get their kids enrolled without fees - others have to pay $10K per year. The best advice I've seen here is to approach the schools directly (not the school board). Also, the parent/sponsor who is Canadian is the one who should speak with the school.
