Hi,

I married my Swedish wife in Sweden this January. I have prepared the sponsorship documents but we have this concern regarding the "living together" part of the sponsorship questionnaire form.

First of all, is it OKAY for her to visit while the application is in process/before going into process? And if so, how can I indicate that I am in Canada AND she lives with me temporarily? (She will be visiting me in Canada and will return to Sweden after 6 weeks)

Thanks in advance,

Mati

If she is temporarily visiting no need to mention that she is living in Canada. The CPC Mississauga has to send the application package to her Visa Office in Spain. If you mention she is living with you in Canada, the case will be different and it should be a processed internally.

I don't think that's quite correct. Someone can be living in Canada and still apply outland. In other words, living in Canada doesn't force you to apply inland.

My husband was living in Canada as a visitor while his application was being processed outland. In the "are you living together" question, we said yes - and indicated we had been living together since 2006. In the detailed write up we mentioned that my husband was here as a visitor and always followed visitor rules (i.e. not working, not overstaying six months, etc.). We also showed (using flight itineraries) that he had spent about 80% of his time in Canada over the last three years and demonstrated that he was using my home as his address (using letters, bills, bank statements, etc.). We felt this was strong evidence that our relationship was genuine.

Our outland application was processed quickly without any issues.

I agree with wilson that six weeks does not equal living together. If it was six months or longer, then I think that would be a different story.

It is OK for her to visit. 6 weeks is not really long enough to be 'living together', so you don't need to put your address in Canada as her address. But, I would mention somewhere that she is here visiting - there is one question where they ask if you have ever lived together. You could explain there that she is staying with you for 6 weeks.

Definitely agreed. Also, even if she was staying with you for longer, that wouldn't mean it would have to be processed inland--"internally", as wilson put it. And her overseas visa office as a Swedish citizen would be London, UK--not Spain.

Thanks everyone for the great info. :)
