Hi everyone,

I have been in a same-sex relationship with a guy for over 5 years now. I just received a Canadian PR and am looking to move there on third week of May 2019. Post that, around October 2019, my boyfriend is planning on applying for a TRV and we plan to get married in Canada when he comes down by the end of this year. I have following questions given this situation:

1. Is this a feasible plan? Is it okay to get married on a tourist visa? Am I making it more complicated that it should be?
2. Can we do it as soon as he arrives in Canada or do we wait for a few months so it doesn’t sound suspicious?
3. What documents would we need to prove that this is all genuine?

Have you been cohabitating over the past five years? Would you be in a common-law relationship already?

If not, are you planning on using this marriage to sponsor him?

If so, this is fine, people do it frequently. You can do it whenever you want, just if you are planning on sponsoring him, remember that it can take some time to get a marriage certificate, which you need to apply for PR. Don't run out of time on his visa before you get married.

Thank you so much for your reply. We haven’t been cohabiting. He is in India and I was in the US until recently. I moved to India in Dec 2018 but we haven’t been living together even here.
Also about proving that the relationship is genuine, I can produce phone call logs, chat logs, emails, photos of trips we took together. Will that be good?
 
Are you planning on using the marriage for PR sponsorship? I'm assuming so, since you don't need to prove anything just to get married.

Those are all things that work towards proving a genuine marriage. If you search this forum, you'll find plenty of threads on proof of relationship.

1. Yes, there's nothing wrong with getting married while he's on a TRV. He may or may not get the TRV, but if he does, nothing stops you from getting married once he arrives in Canada.

2. You can do it anytime you like. If this is a real relationship, there's nothing suspicious about choosing to get married.

3. When you attempt to sponsor your spouse, you will have to prove that your marriage is genuine and not entered into simply for the sake of immigrating to Canada. At this time, you can submit all the proof that you mentioned. If you have five years of proof, things should be smooth sailing and IRCC is unlikely to wonder about the genuineness of your relationship.

I would eventually sponsor him for PR because I want to live with him.

If his savings fall short, I can provide my bank account details and show that I will support him during this trip.

Could anyone let me know the chances of getting the TRV approved?

He should sponsor his own trip and be able to show enough funds on his own to have a solid chance of approval.

Has he previously traveled to countries requiring visas such as the U.S., UK, etc.?
