LMIA EXEMPT WORK PERMIT EXTENSION

I am applying for a new employer.

Here's my situation:

My Alberta WP expired last June 12, 2015. Applied extension before that without LMIA just to buy time. Application returned on July 2, asking for $100 OWP holder fee. Resubmitted the application days later and also Application for restoration. I lost my implied status when it was returned. Now still waiting for restoration decision.

A week later, I also applied for SINP since I got an offer from a new Sask employer. After 1month and 3days, I got nominated.

Then I applied for a new WP supported by an SINP support letter. CIC advised me to write a letter requesting to withdraw the extension application. Problem is, I did not pay the compliance fee and the form. Is it a ground for refusal of my new WP Application?

I then sent my PR Application and was received at CIO on the 22nd of September. I think I also made mistake when put "implied status, applied restoration" on my PR application. I think I am now out of status since the return of my extension application.

So, you have two work permit applications currently in process? One with LMIA and other support letter?

1. If you want to work with your SK employer then you have to restore your status as a worker (since you lost your status on July 2) and apply for a work permit with a new employer using SK support letter. You will be under LMIA exempt category. So, make sure your employer pays $230 compliance fee and fill out required forms and give a copy to you. Your employer has to send that offer of employment to CIC before you can submit along with your work permit application.

Just a quick question: Do you have valid visitor visa? or Are you from visa-exempt country?

Yes, I now have 2 WP applications. 1st one, I know it will be denied for I don't have LMIA or support letter that time. I just did it to buy time to stay longer here in Canada. I also applied my restoration tru that application.

Then here comes August 9, the day when I was nominated. So I applied for 2nd WP (with support letter) and a letter to the immigration officer requesting to CANCEL my first one. But yeah, without compliance fee.

Should I send a new WP application and request again to cancel my 2nd application to give way to my '3rd WP application' with the compliance fee?

I finished my study last year in August. It is a one-year post graduate program. ha.....I know if my job is permanent I can apply OPNP. Just cannot meet all the criteria for any immigration program.....

I have enter the pool, but my ielts is not high enough. I am preparing IELTS now and hope I can get 8777 this time.

FYI: If you will not have any option to extend your work permit by Nov. then just apply for a "work permit extension with LMIA"(even if you won't have a valid LMIA) just to buy some time. Because if you apply before your work permit expires then you can work legally till you get a decision from CIC regarding your work permit application in process.

If you got a rejection for your initially work permit application then you only got 90 days to apply for a new other. Since you did applied twice but both application will be rejected - first - no LMIA, second - you did not submit all the required forms.

If you TRV exempt then you can go to the nearest border and apply for your new work permit over there and you will definitely need all forms filled out by your employer.

But if you are not TRV exempt, then you only got few days to restore your status I believe. Make sure your employer pays the required $230 fee and send a copy of offer of employment to CIC at OfferofEmployment-Offredemploi@cic.gc.ca

So, for your work permit application this time, you need the following documents.

1. Application to change conditions, stay -- IMM 5710
2. Passport copy along with all visa/entry/departure stamps
3. Photo
4. Offer of Employment for a foreign National exempt LMIA
5. Employer Questionnaire.
6. PNP support letter (upload it under proof how you meet the requirements)
7. PNP nomination certificate
8. Employer payment receipt ($230 one)
9. Letter of Explanation ( you should submit a letter and explain your situation why you have overstayed after your work permit expired)

the issuance of a work permit under paragraph R204(c) as per its agreement with Canada have
been met, identifying the occupation and employer information. The required factors include

 that the nominated individual is urgently required by the provincial-based employer who
has made the foreign national a job offer in that province or territory that the job offer is
genuine and the job offer will create economic benefits or opportunities,

 that the employment is not part-time or seasonal, and

 that the wages and working conditions of the employment would be sufficient to attract
and retain Canadian citizens.

They are asking for a support letter from your province. Which province nominated you? Did your work permit expire already?
