LMIA EXEMPT WORK PERMIT EXTENSION

Wow, so you really think there's nothing to worry about? I am freaking out... thank you!!! i an from a visa exempt country (poland). I uploaded everything, though there were those small things that got me worried: after all,my permit was for u of t although because of the complicated structure i am actuslly employed by vic which does not have id... and then on the offer of rmployment form that the employrr submitted there was no way for him to sign because the electronic 'submit' buttin wouldn't work on a signed copy and it wouldn't take an electronic signature,do he sent the unsigned copy but then printed it off, signed, and i submitted the signed one. Sooo i hope that was ok?

So if i have to restore status that's just like applying for a permit again? And can i stay i Canada in the process? And ifthey reject restoration of status can i then apply for visitor status? I'll do evertything to stay with my partner.. thanks!!

Next weekend I want to try to do a port of entry extension (I am from visa exempt country). Does anybody know if I can apply to extend WP at border early (like 4 weeks before my existing WP expires?)

Yes, you can as long as you think you meet all the requirements to get your WP extended.

Offer of employment does not have to be signed by an employer. Below is the link that explains almost every important part of offer of employment form.

FYI: Your WP will be closed so make sure you have submitted this offer of employment through your right employer. If you are working with U of T then offer of employment from them will be required.

I also suggest you to go to the nearest border and apply for your WP there as you can get it right away and then you can withdraw your online application if you don't want to take any chance of getting your online application refused and being out of status after it.

But before trying to get it from the border. May I know if you have open or close WP right now and on what basis did you apply for your WP extension this time?

The reason I am asking all these so I can give you the right advice.

If they rejrct it after it expired i can stay in canada and apply for restoration of status and then visitor status if that doesnt work? Closed means employer specific. So, is your WP based on LMIA or LMIA exempt?

Cool, thanks for the reply! The document pack has been prepared by the HR dept. so I trust they know what they are doing . They (HR) expressed some doubts whether I can extend the WP at POE while the old one is still valid, but I'll give it a try anyway. Really don't want to be on "implied" status

I believe I am allowed total of 5 years as an intra-company transferee and my initial WP was only for 3 years.
Intra-company transferees
NAFTA (and other FTAs similar to the NAFTA) (R204(a), exemption T24), General Provisions under IRPA and GATS R205(a), (exemption C12): Work permits may be issued for the following periods:
Executives and managers: max. initial three years, unless opening an office (one year); two-year renewals allowable; total period of stay may not exceed seven years;
Specialized knowledge transferees: max. initial three years, unless opening an office (one year); two-year renewals allowable; total period of stay may not exceed five years

I am lmia exempt i don't know if i want to go to the border etc yet, but could you please let me know what it looks like if they reject yhe application, do i apply for restoration and visitor or first restoration and thrn when they accept nothing and if they reject then visitor? First and foremost i just want to stay here.

If they reject your application then they will give you 90 days to restore your status and you can stay in Canada but cannot work till you get a decision on your application when you will apply for restoration of your status.

2. Application received by CPC-Vegreville for BOWP on July 9th (currently on implied status)
2. Express Entry ITA received on July 17th and no file number yet or change in status.
3. PNP nomination with work permit support letter received on Aug 8th.
4. I would like to know the chances and risks involved in flagpoling at port of entry for work permit extension as I am not from a Visa exempt country.

Any suggestions and experiences shared would be greatly appreciated.

I don't suggest you to do a flag pole as it is very risky. CBSA officers might not let you enter Canada again because you don't have a valid status (neither WP nor any entry visa ) and you will also lose your implied status as well once you step out of this country.


I suggest you to keep on waiting for a decision to be made on your application because it will atleast give you implied status for another 3-4 months (according to CIC processing time these days) and let you work legally during that period.

Hopefully, you will get your PR application approved by then if it is express entry and you have already applied for it.

If you get a decision on your WP before your PR application then only you will be out of status and will be asked to apply again within 90 days to restore your status but as long as you stay in Canada and don't go anywhere outside of Canada during that time.
