Help!

I have a questions about this document!

I have a Post Graduation Work Permit valid for three years and I am working for a company for one year so far. However, I just checked that my employer is not exempt from LMIA, therefore I would like to know if I can ask my employer to apply for an LMIA to support my Express Entry application?

Yes - you can ask your employer to obtain an LMIA to give you job offer points for Express Entry. Note this is typically a 4-6 month process.

Awesome! So I believe that is better I ask them now because I'm planning to take the English test within this time (4-6 months).

Another question if you don't mind: Is this CIC link (https://www.canada.ca/en/employment-social-development/services/foreign-workers/permanent.html) that my employer has to follow step by step in order to apply?

Yes - it looks like you have the right link. Make sure your employer follows and meets the advertising requirement fully (i.e. length of job advertising, number of places and types of sites advertised) - otherwise the application will end in refusal.

Just to add - make sure you're being paid at least the median wage for your occupation in your province. If not, refusal is again pretty much guaranteed.

How do I check if I'm getting paid at least the median wage? I tried to find out into the Job Bank but I could not find it.

What do you mean with number of places and types of sites?
It's all in the link you posted earlier. Look under recruitment requirements. Your employer will have to advertise the job on at least three recruitment sites (that meet the LMIA requirements) for at least a month prior to submitting the LMIA application. I believe at least one of these ads will have to continue to run until a decision in the LMIA application is made. This is to prove that no Canadian could be found for the job.

I believe that my employer already has one advertisement in one of them, but I'll check it out. Let me be black and white with you. I do work in a restaurant as a line cook which there're already some Canadians working; consequently, my application will be refused? Or this assessement only will count if no one (Canadian) will find the job until my LMIA application is made?
