I suggest you tough it out and try to get both the GC and the Canadian PR. I am an Architect, what do you do?

but in my case. do you think, I should just send all the previous H1 B approval documents as well as the copy H1 B visa stamp from my passport and copy of I-94 and mentioned that I need to add these docs in reference to the new File number that I received from Buffalo CHC? or should I just wait until they ask me for those docs

Yes, send them any documents you feel important. Do not wait for their request. That was what i have done in my case, and have never got any documents request from them.

As long as you received your AOR, and file number from the visa office, you are free to add any documents you want to your file. Do not forget to write your file number and information clearly in the explanation letter attached to the new documents, and explain the documents being sent.

I am a Mexican national living in USA with an expired visa and want to emigrate to Canada, I have a Mexican passport, do I need to go back to Mexico and initiate the whole process or can I travel directly to Canada from the USA.

Have a look at the following case:

The applicant is residing in Canada, and applied for the PR in Buffalo. His legal status expired at the very last stage, after they requested his passport.

After he sent his passport to Fort Erie for visa stamping, they sent him the passport back with a letter stating that his status in Canada has changed, and asking him for an explanation ( because he went out of status).

If they do such a reaction with people who become out of status in Canada, what would be the situation for people in the USA !

My work permit renewal application was refused on Feb 15,2010 and then CIC buffalo asked for my passport to be sent to fort Erie on Feb 25, 2010. I sent them my passport which they received on March 4, 2010. Three weeks later they sent my passport back with a hand written letter from Fort Erie stating that my conditions have changed as my work permit has expired and they need an updated IELTS result.

Lucikly i had just recently given IELTS as I was also planning to apply under the CEC category (which i did not as they asked for my passport). I sent them the new IELTS result and they received it on March 30, 2010. I have not heard anything from them as yet. Its now 5 weeks since Fort Erie received my passport and new IELTS result and no news from them as yet. On ECAS the status is still IN PROCESS with the last update is Medical results have been received.

I have also applied for restoration of status explaining my case to CIC in Vegreville Alberta, requesting that my status be extended till i get my passport back. I have not heard anything from there either.

Can anyone please advise me if i need to do something else or can i contact someone to know the status of my passport as i cannot work and cannot apply for EI either and my savings are running out.

and to add to the above, even if their law is with you they will bend it to make it harder for you to apply from the US if you are not a US citizen.
