I am a bit at lost these days. We filed back in December 2009, and are still waiting. I would like suggestion and what to do and what to expect next.
Most application going through Lima seems to take about 9-12 months from what I have observed on here and trackitt, a few exception even less...
Last October we were requested to send in the police clearances for Peru and Mexico, since husbands has lived abroad (Mexico and USA), but not for the USA. We had already provided them with an FBI clearance since we had it on hand at the time of filling( for other previous purpose), but had decided to wait for the other, as it stated on CIC website, that for the Mexican clearance to wait until they were requested by the embassy before sending them.
We provided them with the Peruvian clearances, and sent them the necessary documents for them to get the Federal Mexican clearance as per their instructions on their website.
I understand that my case is a bit more complicated than most (husband was illegal in Mexico and USA), and we have failed to provide them so far with one of the requested police clearance, for one of the State in which he lived in for 5 months in Mexico. As we are unable to get it (trust me we tired, sent friends with his documents, called numerous time the office, we were given various conflicting information, but nothing we tried ever worked). Instead we have recently sent them an affidavit that was notarized explaining the complications, and him saying he had never been convicted of any crimes. I am also currently in touch with a Mexican lawyer that says he can get it for us. At the same time, we provided them with new evidences of our relationship over the last year and a half.
Also our lawyer contacted them back in March 2011 to get some sort of updates, and asking if please they could advise us what to do about the missing clearance. They never replied.
I just wanted to know if those more experienced could maybe give me some feed back on my situation and maybe help me understand what is holding up our application so long, or what I can do to get some sort of updates, or instructions about the missing affidavit.
I also understand that police clearances are important but what happens when a person can not provide one ? How could that affect the whole thing ? Does that make him illegible right off ? And if it is the case, why would they keep us waiting any longer ?
Also knowing that the regular estimated times for Lima is 12 months, and considering those complications, should I be worried or are these delays somewhat normal given the circumstances.
Is there such a thing in Immigration as an application taking to long, and when does it become to long ? And what resources do we have to make things move ?
I see people taking about CAIPS notes and getting helped by their MP. I went over those options with the lawyers, but they pretty much summed it up to , " we know this is frustrating for you, but since your case is some what more complicated, the only thing that you can do is to be more patient", and said that these things were used, done in situation more complicated or after an application was refused.
Hope someone here can give me some answers... I really need some. I don't mind waiting some more after having waited so long, but I just need some answers and some idea of what might be happening so we can plan for the next couple of months if that is possible at all...
I can wait some more time. I just want an idea of how much longer so we can organize our lives better around that. Had I know form the start if would be that long, I would have not have waited for him here in Canada and I would have gone with him. I would still go now, but financially after having travelled 4 times to Peru I am not in a position anymore to do so...
