Hello,

I signed a one-year contract on July 1st, 2012. I have not signed any new lease with them after it ended.

Now, I want to leave. Shall I serve a two-month notice or only one?

I am in Ontario.

you have to provide 60 days notice to your landlord.

Thank you. I sent an email yesterday informing them of my intention to leave on Dec 31st. Have not heard from them yet.

If they did not accept, can I leave on the 10th of Jan? my cheques are signed on the `st of each month.

You're not requesting for permission, it's a firm notice like quitting your job. Don't worry, just make sure they received the notice and have them return your cheques. You may want to look into the rules for acceptable methods of handing a 60 days notice to the landlord.

EDIT: You have to provide 60 days notice, not notice until the end of the next month. We are already half-way through November, so you may be on the hook until end of January if the landlord quotes the Residential Tenancies Act.
