Hello all,

I am desperate and in need of some expert advice so please bear with me...

I am currently on an IEC 2 year work and travel visa which expires November 24th of this year so I am really fighting against time here.

I am eligible for CEC Express Entry aslong as I score high in my CELPIP results.

I have sat this test 5 times now and each time travel the 3 hours to Calgary to sit this test. I have consistently score between 10-12 for reading, listening and speaking but can not get higher than an 8 for writing. I need a 9 to be eligible to submit an application.

I received my lastest results minutes ago and again only scored 8 for writing. I did everything I could, researched online, took tests and I honestly thought I nailed it this time. I have just paid for a re-evaluation as I have every time before but I feel like again, it will not be remarked higher than an 8.

My question is, what are my next steps? I am desperate to stay in this country but it seems that Express Entry is out of the question.

Let’s say my score is remarked to a 9, perfect but I really need to submit a profile now so I can be hopefully chosen for the end of month invites however, in order to submit a profile, you need the date the hard certificate is signed, am I able to do this without it or make a date up and then change my date afterwards once I receive an invite?

If I’m not scored higher, do I have enough time to apply for PNP? What do I need to do now if I want to stay on the PNP? My company has agreed to help me through this. I know you need to be employed for 9 months but I’ve only been working for them for 4 months. Is there any extension I can get in order to prolong my time in Canada so I can apply for the PNP in March of next year?

As you can see, I’ve tried to do this without a lawyer but it seems time is not on my side.

I also do not have enough time on my visa to sit the CELPIP again. I need to make a Plan B now,
 
If you don't receive ITA in time, then there are really two options for being able to stay in Canada longer and work. The first is to apply for another IEC if you qualify for one and if there are still IECs available in your country's pool. The second would be for your employer to obtain an approved LMIA so that you can apply for a closed work permit. There isn't sufficient time for your employer to obtain an LMIA between now and when your work permit expires. So you'll need to change your status to visitor and stop working while you wait for the LMIA to be approved and then wait for your closed work permit to be approved. Good luck.

Sadly I don’t qualify for another IEC visa.

I know you can apply for a bridging visa whilst waiting to hear if your application has been successful or not but I won’t have submitted an application as I need to somehow extend my stay till March so then I can apply for PNP but my current IEC visa expires next month!

A closed work permit is tied to a specific employer. An open work permit allows you to work for anyone.

No - you do not need to have a NOC A, B or 0 job for your employer to be able to obtain an approved LMIA. The closed work permit has nothing to do with having an EE application submitted. Your employer needs to obtain an approved LMIA before you can apply for a closed work permit. The LMIA process typically takes several months to complete.
