Congrats to all who have heard some good news....well since every1 started getting updates i decided to check ecas and it went into process..i am wondering how can it go into process when they already have my passport..

It simply means that your application is in process and it will change to decision made when they return your passport.

This is a positive sign, Saskia!

Wow, I am totally impressed by this forum. I am actually really new to this entire type of thing. So bear with me.

So here's my story.
My hubby stayed passed his visa for the farm workers program in February 2011.
Met my hubby and love of my life April 2012 and moved in together on August 2012. I have a very highly special needs son who adores my hubby and he him. They have a very special bond.
I got diagnosed with cervical cancer in October 2012 and he proposed to me on December 10, 2012 in the cancer clinic when he wanted to prove his love and devotion for me.
He got stopped by the police in a van with other people on December 17, 2012 and they were all asked for id. He gave them his and was immediately arrested and taken to the Rexdale holding facility. I was scheduled for surgery the following day. So I pleaded with them to let him out on $3000 bail. They released him on the 19th and I had to postpone my surgery.
We went to a lawyer who told us to apply for H&C but then submitted the application wrong. We were offered the PRRA because I believe the CBSA officer who was in charge of our file had a heart and realized I needed him to be with me through this process.
Our PRRA was denied on May 17, 2013 and they gave us until August 25, 2013 for his removal to give us time to get married and sort out our affairs. In the meantime my ex-husband refused to give me the divorce and held up the process, so the office told us to appeal the PRRA decision based on humanitarian grounds. So we did and spent $4000 for a lawyer to file the appeal.
My divorce finally came through on July 17th and we were married on the 20th of July. As soon as we legally could.
1 week before the removal was scheduled, we hadn't heard from the supreme court to let us know so the lawyer told us to request a deferral of removal which was denied at his removal interview 2 days before he left.
In the meantime we were told to submit our spousal sponsorship from in Canada which we did and was received on August 8th.
I went down on Sept 4 to stay with hubby. Before I left I spoke with immigration about our specific situation with my son and she told me to take all supporting documents with me to Jamaica and apply for an ARC separate from a TRV. When we got there, they wouldn't allow us to do it so we had to apply for a TRV which was vehemently denied saying you are barred from Canada for 1 year and do not reapply until your circumstances have drastically changed.
So now we have to withdraw our in country application and reapply for our out of country sponsorship and I'm afraid that all the things we've tried to do in the past are going to go against us and they won't allow him to come back. He was issued an exclusion order for 1 year.
It's so frustrating because you don't get the correct advise. I just got back yesterday and I am exhausted with this whole process.

Well it sounds like a series of mistake after mistake but it can be fixed. Put in your application for outland ASAP as most times it takes over a year for this process to finish and by that time he will have gone past his one year ban and then you won't need the ARC! As for the all the past things, they shouldn't come up against you, just remember to tell the truth as they already have his information and that will stay on your record and they will be able to see everything even though the two process are different. When I log into ECAS with my hubbys old UCI # from his refugee claim, the information for our spousal sponsor is all there now. Another thing to remember is that hubby should remember all his dates for EVERYTHING! in case they ask for an interview and they like to ask a lot of dates in interviews from what I have been told. Everything will work out in the end and if you have anymore questions just let us know, there are alot of great people on here and we will help you out no problem and we are free! unlike the lawyers that take your money. Welcome again to our little home away from home!

Just curious. What are the average processing times? I know the site says 20-22 months, but a friend of mine who is an immigration officer told me 7-8 months in realilty. Is that true?

You have an incredible story. I am new to this immigration process too. I am not married yet however my fiancé also has an exclusion order for 1 year due to overstay.

I cant speak to the immigration portions, but as a nurse I would try to obtain some type of medical documents to demonstrate the need for your husband to support your during your recovery. As you know stress, can cause physicological changes and it is important to have a a great support system. In addition it is a well known fact that people recover better and return to there normal function when they have a good support system.

I would also advise immigration of the implications seperation and determent this could cause your son who has developed a bond with your husband! I dont know what type of challenges your son has, but I can tell you working with children that are medically fragile and technologivally dependent, do not take well to changes! if I bond has been formed, it is important to creat consistency! I am sure you are aware of that.

When health and wellness of children are involved I tend to take things personal >:(. I would try to find supporting medical documentation to present to immigration.

Welcome Lexi to our forum family,

Everything will work out just fine for hubby and you like Chickie mentioned put in your outland application as soon as possible as wait times are beyond ridiculous. I am sorry to hear about all the run arounds that this process has put you and your family through. You defiantly have and are going through a lot with a special needs child and the cancer you got passed. Your a very strong woman and I am blessed to read your story was very touching. Were all here to help and be supportive so feel free to ask way. As for myself I am also going through an exclusion order with my husband on a 1 year ban. He was on the farm workers program and over stayed. Take care and stay positive darling this journey will soon come to an end.

Hey there, when my ECAS changed to In Process that is when my eligibility changed to passed in my notes....i never seen on my notes that the eligibility was is in progress, it just went to passed but now our criminality says in progress.
