I'm in the same exact situation and I told him this lawyer is playing with our life. I told my husband don't worry I have faith and believe you won't need an interview. I'm hoping for dec he will get to come home. No arc was needed right? Thanks Neika am I looking at 18 months?
 
They did not ask for an ARC for my husband because by the time they started processing our file the year already expired. Dont worry your file may not take as long as mine because i sponsored my husband and his son and cic requested dna for my hubby and his son. The dna added almost 6 mths to my application.also my mp told me that as long you can prove that you have a genuine relationship the overstay is not a big deal

Whew that's a relief if he comes up before one year then that's when I pay for an arc? Apparently our application is already in process when I emailed them in feb asking if our application arrived in ja. I'm sending in 60 pages of additional proof over the 4 months he's been there. Should this be enough proof?
 
Wow that's good that they've already started processing your case. 60 pages is should be more than enough proof and yes they will only request arc if the year have nit expired and it will be dealt with will they are processing your application.

The application the lawyer filled out so it's pretty straight forward only have hubby to sponsor. Praying God will be on our side as I am struggling financially and emotionally living with a stressful unsupportive mother.

That's what i told hubby not to worry. I feel like changing the mailing address from his office address to my address. He's not doing anything for his money. Hubby will blast him on Wednesday.

I'm sorry to hear that hon, we are all here for you. I remember this being so emotionally and financially draining also had to deal with unsupportive ppl as well just trust God and this too shall pass.

Yes if he is an immigration officer then he should know that they only ask for an interview if they feel your relationship is not genuine.........or if they have additional questions.....hubby and I were together for 2 1/2 years while he was up here and i think he may be referring like if you only met within a couple of months then yes of course they may ask for an interview.

I only pay the 400ARC if kingston grants a visa before nov 2013 and he wants to come home. If I wait past nov I don't need to pay for an arc that's the letter ur talking about. My husband has a different case from chickie he isn't a denied refugee. My husband just overstayed his visa.

I thought that they needed the ARC if they over stayed as well. But it's only done case by case

I think it all depends on each individual case.....for example like how they left, if they left on their own, if they were picked up for criminal reasons etc but most cases if they left on their own, it seems like they haven't been asking for an arc.
