Hey there can anyone answer a question for me cause now she has got me wondering....if you use a lawyer/representative....will they still answer your emails if you email them or do they only go thru your representative? Just curious for her! :)

We used a representative and they reply to me directly with my emails.

Well that lawyer doesn't seem interested to be giving me answers what I am satisfied with. When hubby flew out I asked him how long is this process he stated 8 to 10 months but I'm not keeping his word. I am going to email kingston tomorrow morning and find out what they say. I just having that feeling if kingston sends the lawyer any word they will take their sweet time to delivery the news to me.

Hey Forum!

So sorry to hear of the storm in GTA. I hope everyone is warm and well. We have tons of snow out here but have stayed at an avg of -5 temperatures since hubby arrived.

To show him how it is to be a true Canadian, we are BBQing tonight out in the snow!! lol

He loves it!

Life is good! Have a good weekend peeps!

Once they get paid they tell you b.s n give up on you....at least ours did after he guaranteed us 6 months for overseas sponsership. All this and after we submitted a inland one in April and had to withdraw it because I realized we should have done outland from the jump. Again....he gave his Bad advice and he still didn't. We wasted 3 months of waiting time

That's horrible I must say this lawyer is good in away my husband left canada without having to go to jail and get bail for an overstay. He had connections with a immigration officer he dealt with my hubby.

Hi Everyone,

It's a terribly cold and snowy day today. Thank goodness for snow tires or my poor car may not have made it up a few hills like others I saw.
Was in meetings all day and just got caught up on today's posts.

It appears as though there is some ambiguity around what happens to files when it's received by the foreign visa office and in our case Kingston as to whether it gets opened immediately or sits untouched for months on end. Files technically go in process almost immediately. eCAS can cause much confusion since the VO in most cases updates it near the end, when they are about to make a decision of approved or denied. Rest assured that files are opened fairly quickly and goes through a series of preliminary review processes to ensure applications are complete and have the required documents as per the checklist. Once these checks are performed, and depending on the scope of review they've determined is required for your file, they will assign it to a category they've deemed as appropriate for your application. Sort of like a fast lane and a slow lane. This will all depend your individual circumstances.

If all is good, it goes into queue for a formal initial review at which point, the evidence to support the bona fides of your relationship is examined by a senior staff member thus immigration officer. At this stage, they'll make a decision if whether the application will move onto the next stage of processing, request interview, or deny.

Next stage of processing entails security and background checks however the applicant will have needed to pass the initial review before they move to this stage as you are applying under spousal sponsorship and would need to satisfy these criterias first; the bona fides of relationship. There are also different levels of security checks performed which would determine how quickly your file gets completed. Level 1 to 3. Through background checks, it can come back as a pass or fail at which point the visa officer will make a decision based on the findings to pass, request for an interview, request additional documentation or deny it completely.

To conclude this entire process, only once the application gets a pass for all checks, (genuiness of relationship, medicals, security, background), the file goes in queue for final review by the final decision maker, the visa officer. Based on an audit from 2010, Kingston has 2 official visa officers who is assigned to the family class sponsorship. There are a number of locals hires who provide admin support in junior to intermediate capacities. Their is a fraud department who verifies documents and a migration officer stationed to investigate applicants. Background checks are performed by CSIS which is a separate entity from immigration. As you can see, there a quite a few moving parts to this process and it's not immigration particularly that holds up files as some parts are out of their control.

Hope this helps with a general overview of what happens on the inside.

Stay warm this weekend and know that your file is not being used as a paper weight or collecting dust.

Ive left him as a rep because if we need to appeal I thought u had to have a consultant representing for that.
But I have found out more info myself than he has ever given us.

My hubby case is complex too. Came to farm program and left...filed refugee status and then got pulled over and CBSA had his incorrect birthdate and held him for bail ...
Then his consultant advised praa ...so we could try inland sponsorship...this was bad mistake cause he should have gone home n started outland from April. This is why I.have no faith in ours.
I even did the application myself and he still was advising us to send it in without certain documents in the package.
He just didnt sem to care cause he allready made his $ from the refugee stuff and he knew we was out of money.

Good information.
Very well explained.
Thank you ...
I also tried to send them doctors notes and personal letters asking for hubbys urgent return for the birth of his son in march...
They didn't care as I thought. But I tried. They emailed me back saying we have received your document regarding pregnancy and Mr.hubbys file remains in initial review queue.
That's Tuesdays reply ..and thats when I got discouraged again .. but our case is not so easy I.guess due to his stay in canada was a rollercoaster ride in itself.

that is just crazy......my hubby went thru kinda the same thing......the PRRA and everything.....found out after if we had married before the PRRA and he didn't do it then he coulda stayed and done inland.....didn't find that out until he was already in JA.....God knows why it happened the way it did

Glad you have learned alot because at least he can't pull the wool over your eyes no more! Some of them just want the money they don't actually care about the people
