I have a job offer from my current employer. I don’t need an LMIA to claim the 50 points for it because IEC is an international agreement.

The problem is my current visa expires in 2 days. Since I have applied for a Bridging Visa I can continue working on implied status until a decision regarding my Bridging Visa or PR application is made.

I am not sure if I can still claim the 50 points while I am on implied status.

Anybody in a similar situation?

Of course, you can claim. The implied status is what allows you to stay in Canada.

The job offer has to be valid though. Meaning, that its an offer for at least a year in a valid NOC starting when you obtain your PR.

I'm a little bit confused from your post. I was in a similar situation to you I'm a little further along in the process now waiting for PPR.

My first question is the bridging visa you need to be working in a skilled job NOC A or B to qualify. So are you?

Secondly are you getting job offer mixed up with experience? A job offer to be valid has to have an LMIA exception code or an LMIA.

A little about my story I was on IEC working in Skill B so I was eligible for the bridging visa. I never claimed my job offer for points as I didnt have a valid LMIA or LMIA exception. I did however claim the 1 year of Canadian work experience which is about 25 points I believe.

If you believe you qualify for an LMIA exception I would still check with a specialist. Because down the road CIC will ask to you to prove everything and it could screw your application up it's not worth it.

Your question is confusing.

First of all, you don't qualify for the 50 job offer points. Presumably you hold a Working Holiday Visa which is an open work permit where the employer is not named. If so, your employer would need to obtain an approved LMIA in order for you to qualify for the 50 points. What you have now isn't classified as a job offer for immigration purposes.

Have you already received ITA through Express Entry (i.e. been selected out of the pool) and submitted your application for PR? You can only apply for a BOWP once you've been selected for PR and have applied.

Hi All,

thank you very much for your response.

I submitted my PR application last week and with the AOR I applied for the BOWP.

Currently, I am on an employer specific work permit (Young Professional, belongs to IEC), that expires in two days.

That visa is LMIA exempt and falls under *exempt for Canadian interest reasons --> reciprocal employment--> International Experience Canada – a work abroad program for youth and young professionals. So I can claim the 50 points, but can I still claim it even though I will be on implied status soon?

For Express Entry, your employer doesn’t need an LMIA if you:

  1. have been working full-time for the employer on your work permit for at least one year (or an equal amount of part-time work)
  2. have a valid job offer, and
  3. have a valid work permit that is exempt from an LMIA under
    • an international agreement
    • a federal-provincial agreement or
    • the “Canadian interests” category
Note: For skilled trade jobs, up to two employers can make a job offer. You must work for both those employers.

Jobs exempt from the LMIA
You may be exempt from needing an LMIA for Express Entry if your current temporary job is LMIA-exempt, states a specific employer or employers (for skilled trade jobs, up to two employers can make a job offer), and is:

  1. covered by an international agreement like NAFTA or GATS, and non-trade agreements. This can include professionals, traders and investors.
  2. covered by an agreement between Canada and a province or territory. This includes “significant investment” projects.
  3. exempt for “Canadian interests” reasons:
    1. “significant benefit” – if your employer can prove you will bring an important social, cultural, and/or economic benefit to Canada. This can include:
      1. general: Self-employed engineers, technical workers, creative and performing artists, etc.
      2. workers transferred within a company (intra-company transferees with specialized knowledge) – only those that will benefit Canada with their skills and experience
      3. workers under Mobilité francophone
    2. reciprocal employment – lets foreign workers get jobs in Canada when Canadians have similar opportunities in other countries
      1. general (such as professional coaches and athletes working for Canadian teams)
      2. International Experience Canada – a work abroad program for youth and young professionals
      3. people in exchange programs like professors and visiting lecturers
    3. designated by the Minister
      1. academics, including researchers, guest lecturers and visiting professors (sponsored through a recognized federal program)
      2. competitiveness and public policy
        • medical residents and fellows
        • post-doctoral fellows and people who have won academic awards from Canadian schools
    4. Charity and religious work (not including volunteers)

You are fine then. Your 50 points are legit since YP is employer specific WP. I did the same as you. Since you applied for PR and also have the BOWP in, you are secure. Implied status does not affect the 50 points. Just do not leave Canada, because you will lose implied status.

I have an postgraduate open work permit that just expired. As a result the job I was in, the employer had to terminate me ( frustration of employment) as a result because I no longer have a valid work permit. Prior to that I submitted an express entry profile. My status has now changed. Should I change my express entry profile which is one point under the lowest ranked candidate or leave it. Also, will it bring down my points as I didn’t need to get an LMIA as I was on an open work permit so technically get no points really for valid job offer but Canadian work experience. What should I do? I’m lost

Therefore I have completed 1 full year Canadian work experience but with my open work permit. Since it just expired, do I have to make this change

You have 459 points with job offer and 1 year experience? You can claim the points for your 1 year work experience but you cant claim points for the job offer.

Make sure you keep your status valid in Canada. I'm assuming you applied to change your status to visitor before your work permit expired. You need to have valid status in Canada to apply for PR through an economic immigration stream (if you are applying from within Canada).

Dear fnds please advice on below.!

My fnd submitted PR application in CEC and received the AOR. He is working on a closed work permit in Canada for the employer for more than an year and claimed 50 points for Job Offer given by the same employer. The job offer is LMIA exempted.

Now his employer want to transfer him to US while the PR application in progress. Does it impact the points claimed for job offer? or his in progress application in anyway.?
