Hi I'm on maternity leave for 3 months my working permit is expired on March 2015, but my common law is not divorce yet it is possible that he can apply me an open permit? My common law is canadian citizen! Thank u and have a good day! God bless us!

No - not possible.

Being common law with a Canadian citizen does not qualify you to apply for an open work permit.

You can't be in common law if he is still married?

Yes - you can. If the married couple has separated and one spouse is living with someone else common law - then it's absolutely possible.

If you are really common law (i.e. have lived together for at least one full year) then he can sponsor you for PR. You can read about your options here:

It still sounds complicated for me and not sure why he doesn't file for divorce.
