Why are some people been giving opportunity to resubmit IMM5669 ( to mention previous visa refusal) while others are either refuse straight away or asked to submit procedural fairness letter?

I understood you but my point is this. If they are giving chance or ignoring people who forgot to mention previous visa refusal by approving the permanent residency then it should be do to everyone who have made the same mistakes. They will have a lot of court cases and will definitely loose
Actually the government rarely lose. Refusals are based on IRCC law so if VO followed the law, you will lose.
