Is my newborn Canadian Citizen?

Hi All,

My newborn baby was born in Canada in August 2012. Both my husband and I are currently on work permit status but we have submitted our PR application and currently waiting for approval.

Therefore, I wish to know whether my newborn is Canadian? Can we apply for Canadian Passport with my newborn birth certificate obtained in Canada?

Absolutely, unless our government passed new law saying only citizens kids born here citizen, they can pass any law these days.

Yes, as long as you are not diplomats or UN or foreign military in Canada, your newborn is Canadian.

I've found the following statement in CIC website:

Provincial or territorial birth certificates are often enough to prove that you are a Canadian citizen if you were born in Canada.

Your birth certificate cannot serve as proof of citizenship if you were born in Canada after February 14, 1977, and at the time of your birth, your parents were neither Canadian citizens nor permanent residents, and at least one parent had diplomatic status in Canada.

Does it mean that my newborn is not a Canadian Citizen since we have not obtain our Permanent Residence?

You are forgetting to read the "and" above. I made it red so you'd notice. That means that the above only applies if one of you is a diplomat.

That means I can apply passport for my newborn?

My next query is about the passport application where it state that it require a guarantor and need to be a Canadian Citizen and have known the applicant for 2 years. In my case, I've been in Canada for only 1 year and therefore I cannot fulfil this requirement but I've noted that if I have not known an eligible guarantor for at least 2 years, I can complete a PPTC 132, Statutory Declaration in Lieu of Guarantor, in Passport Canada office. But, how complicated is it and how long will it take to process the application?

Yes, you can apply for a passport for your newborn. I do not know if a Statutory Declaration in Lieu of Guarantor will take longer or be more complicated than using a guarantor but it is not like you have a choice.

No need to inform CIC about your Canadian newborn.

Just send them an updated additional family information form as a courtesy. Your baby does not need to be sponsored so does not need to be in your IMM0008
