Is it legal to have my spouse take my belongings with her before I land?

Hi all,

our Spousal Sponsorship has been approved and I'll be landing in March of next year. However, my wife is coming to visit me in December/January and we were thinking that she could take one piece of luggage with my belongings with her, but we're concerned that this might not be legal. Is there a way to do this the legal way? Maybe have her claim it as my stuff? Because IF customs were to open it, they would see that it doesn't belong to her. I don't want to risk getting in any sort of trouble, so if there isn't anything legal we can do, we just won't do it.

Your input would be greatly appreciated.

It doesn't matter who it belongs to. Customs will treat it as hers and charge any applicable taxes and duties on it. It's not covered by the Settlers exemptions. As long as she declares everything to Customs, there probably won't be a legal problem.

Thank you zardoz. What would have to be declared though? The stuff I would give her is all used and not worth much, probably mostly clothes.

I don't know if this will help, but I have brought clothes and other common household items with me on the plane to Canada as well as bringing my pets with me. My husband brought a few of my items in his luggage and brought one of my pets, too. They didn't seem to think anything of it but they did make a visitor record for me this last time and told me I can't work until I am immigrated and to make sure I know how long I can visit for.

I think it's different when you enter Canada together and just basically have all your belongings in your luggage together (if I understood it right).

Every time i went back home to the UK i brought back an extra suitcase with my husbands things in it . As long as the items you bring in do not exceed the amount on your customs forms you can bring it . If the amount exceeds that they your wife will have to pay duty .
