Is it counted as working overtime? Need help

Discussion in 'Canadian Labour Legislation' started by Sheeba Bernard, Nov 1, 2016.

  1. My friend works as a shift manager at burger king. He works at two stores but both the stores are owned by the same employer. He has been working for long shifts at both stores and if hours worked at both stores are counted, he works overtime but if they are counted separately for each store then they are not. Should he be paid for working overtime as the employer is same?
  2. The employer may have them listed as two different companies for all you know. If he gets one pay slip with all the hours on it, he should get the overtime. If he gets two different pay slips and two T4's at the end of the year he should look at the company names on them. In that case, it's like he works for two employers even though it is the same owner.
