Well, you might be right, but I don't think that makes sense. If the BOWP is only valid until the decision is made on the PR, why is it valid for one year? it could easily indicats in the WP that upon decision made something like this...

I agree that since there is valid date on the WP, it will be valid until that date. :(
 
Can someone with experience please clear this up?
There are a lot of us here who are on BOWP while our PR applications are being processed and would like to know if our permits are still valid if our application gets rejected down the line. Ideally, people need this remaining time on their BOWP to reapply or assess their situation..

It clearly says "valid for a year", and nothing about "validity depends on the PR application decision".
 
I think this is a good point to check with CIC, even though its not mentioned any where about the dependency of the BOWP and the PR application.

I will try to check with some KPMG lawyers if they have any clue about this.

But may be we shouldnt take this up with CIC, if they have not thought about this loop hole(if its a loop hole)
 
According to IRPR (209): "A work permit becomes invalid when it expires or when a removal order that is made against the permit holder becomes enforceable."

It is general rule for work permit. So i think it applies on BOWP too.

There is a written law which is in force for marriages and legal conjugations. In those events, the sponser sends the application and applies for his/her spouse - so the prime mover there is the sponser - and not the "applicant". Therefore, in the event of the sponser ot being there, the law clearly states the terms.

It makes perfect sense that WP will only expire on the date of expiry and not before that irrespective of the result or PR application. If you look at the forms, its pretty much same as applying for off campus work permit once you have completed your studies in Canada.

samething happened with my friend's sister too and we are not able to help her.
Can you please confirm if the open work permit expires after PR refusal even if there is a valid date?

Has this debate been settled? Can you stay and work once your PR is refused but you have a valid BOWP?

I hope you noticed that that was a VERY OLD thread.

Your BOWP is valid for one year. If your PR application is refused after you receive your BOWP, you can stay and work until the end of your BOWP. You can also submit a new PR application, and apply for a new BOWP (if you meet the conditions at the time).
