IRCC: Studying More Than 50% Online Due to COVID Won't Fetch points for Express Entry

for PGWP - you can study online till april 21.
for points - you need to complete atleast 50% your course in Canada.
I've consulted with my DLI and their immigration advisor and they said if you are studying online you can until April it will fetch points for crs and it will allow for pgwp.

This is been cleared by ircc on twitter that you will get points on CRS score ... you guys can check on twitter they replied on 9/9/2020.

This is quite confusing, because based on the Comprehensive Ranking System tool, these are the requirements:

  • English or French as a Second Language must not have made up more than half your study
  • you must not have studied under an award that required you to return to your home country after graduation to apply your skills and knowledge
  • you must have studied at a school within Canada (foreign campuses don’t count)
  • you had to be enrolled full time for at least eight months, and have been physically present in Canada for at least eight months
There is no mention regarding distance learning/online learning.

The only thing they require is that, the student has been physically present in Canada for at least eight months. Hence, the problem is with students who are taking online classes outside of Canada.

Please note you cannot take anything on twitter at face value.
If this is the case why haven't kubeir or the other experts haven't addressed it in their Facebook groups.
Simply because crs points will be rewarded.
Designated immigration advisors have confirmed it.
But do believe what you want. It is definitely up to you to take on unnecessary stress ‍♀

Physical presence is the key point here
That's my point. If we base it on the Comprehensive Ranking System Tool, if you are taking classes online, but you are physically in Canada, you would most likely receive points. However, if you are taking online classes outside of Canada, then maybe you would not receive points.

From the current Ministerial Instructions respecting the Express Entry system, see section 30(5)(b) underlined below.
Points for Canadian educational credential
30 (1)
The points that may be assigned for Canadian educational credential factors are the following...

Requirements
(3)
Points are only assigned under subsection (1) if, for the purpose of obtaining the credential, the foreign national
  • (a) studied in Canada at a Canadian educational institution;
  • (b) was enrolled in full-time study or training for at least eight months; and
  • (c) was physically present in Canada for at least eight months.
Exceptions
(5)
For the purpose of this section, the following are not eligible credentials:
  • (a) credentials obtained in a study or training program in which the study of English or French as a second language amounted to more than half of the program;
  • (b) credentials obtained in a study or training program in which distance learning amounted to more than half of the program; or
  • (c) credentials obtained in a study or training program while receiving a scholarship or fellowship that stipulated that the recipient return to their home country to apply the knowledge and skills gained.

This doesn't make sense. Why would they allow the work permit but not allow the crs points?
Because the Ministerial Instructions do not allow for points to be given for distance learning courses. They would have to go through the legal process to promulgate new Ministerial Instructions.

Okay but my DLI made it clear the next semester will be online. So if I'm there and it's online. I won't receive points?
