We are gathering documents and eveything takes so much time, trying to figure out the time it will take to obtain the US police clearance too. Hence we thought we will look into consultation or lawyer to ease the stress! Other than overstaying for yearsssss…all is good. Thank you for the reply
Keep this in mind:
A consultant (or lawyer) will not be of any [real] value in terms of the overstay. The Public Policy works for those that have representation...and those that do this themselves. Many successful applicants had overstayed for MANY years.

Get the application submitted ASAP.

A lot has changed over the years, but that policy has been in place for years:
https://www.canada.ca/en/immigratio...on-refugee-protection-act-spousal-policy.html
(see section 3)

It's also important to note that this policy may not be in place forever; especially in lieu of recent events in the news regarding possible changes to Canadian immigration in future. I hope that you will agree that it is a very generous policy.

Hey I overstayed during covid for a few years, I was just truthful on my application and my husband and I submitted the application online ourselves and had no issues. We got the US police clearance done in a place in toronto, there is a list on the immigration site of places to get this done.

Absolutely agreed with you. I feel so lucky to be a Canadian with a government that actually cares about keeping family together. We have 2 little kids (both Canadian) as well and it would be devastating for them to grow up without their father by their sides.
I keep working on gathering documents aiming for having everything submitted by end of July! It’s much harder to gather official proof that he actually lived here in Canada with me when everything is under my name because of status issues.

We are so grateful that we live in Canada. Happy Canada Day everyone!!

We are in Calgary, looks like we need to do the online application first, then mail in the fingerprints from a RCMP accredited place. It’s telling me it can take up to 5 weeks!!!!

If he happens to be working have him stop until the has AIP and an approved open work permit. Avoid the risk of him being caught after all this time.

He hasn’t worked in years which now I am thankful for. He’s a full time stay at home husband/dad. We simply cannot function without him. Hence I am doing all the preparation to ease his stress of he may not see our kids if anything happens. The whole process scares us and now hoping to do the right thing! We are so embarrassed about it

You're overthinking part of this.

While it is true that you have to prove that you are living together in Canada...If you were trying to prove that you were living together as common-law, THEN you would have a burden.
The fact that you are married, makes that burden much smaller.

Just provide whatever evidence you have that he is cohabiting with you NOW, as well as when the application is submitted.

Good luck!
