Hi guys,

My wife is canadian. We applied for inland sponsorship (and permanent residence) and the application was received by Vegreville on July 26th.
I entered Canada in February 4th with a visitor visa, and it will expire in august 4th.

I didnt applied for an open work permit.

Question: Since the application was received before my status expire, am I in implied status? Or will I be illegal? What do I have to do? I am confused.

Thanks for your help.

You need to apply for an extension of your visitor status to stay legal. Do it quickly, make sure it is submitted before Aug 4th. Make sure you submit proof that you sent the PR application to CPC-V. With an OWP, you would have had implied status. Without it, you don't have that, so you need to apply for the extension to give you implied status until a decision is made on that request to extend. If you can't get the extension off in time, you can apply for a restoration of status instead.

Thank you for your reply.

The CIC website says that I can't apply to extend my stay in less than 30 days before my visa expires.
Should I apply for restoration of status now?

Thanks

I'm pretty sure it says you should try to extend at least 30 days before your status expires, not that you can't extend it with less than that left.

"If your current temporary resident status is still valid you can apply for an extension of your stay providing you apply at least 30 days before the expiry date of your current status."

You can't apply for a restoration of something you hadn't lost at the time of your application. Your status is still valid, you can still apply for an extension. If you can't complete and submit the extension application before Saturday, then submit a restoration request as soon as possible thereafter.

I just tried the online application to extend the stay. When I was asked about the date of the immigration stamp in my passport, I said exact 6 months ago (which is not true, because the date is february 4th), and the self assessment tool said:

According to the answers you have provided, you are eligible to apply to extend your stay in Canada as a visitor.

IMPORTANT: You must submit your application today. If you do not your status will expire, and to restore your status, you will be required to pay a fee of $200.

You can apply online to extend your stay as a visitor.

MyCIC is your space on the Citizenship and Immigration Canada website. MyCIC allows you to apply and pay online. You can also use MyCIC to update your e-mail address and view your application correspondence from CIC.

You will need a Government of Canada Access Key to access MyCIC.
So I can apply today right? Did I missunderstand?
