Hi Everybody. My story is 20 years old. My family and I were granted our PR in 1996. We lived in Canada for 3 years but had to return to South Africa due to family obligations. For the last 20 years we have been misinformed by CIC and advised to submit various application forms. We have returned to Canada on numerous occasions and been issued with Visitors visas as well as my daughter been granted a study visa. At no point were we told we still had PR and it has cost us a small fortune in visa fees as well as international university fees. We have never renounced our PR and have informed CIC that it was our intention to return to Canada from as far back as 2003. My daughter and her husband applied for and was granted PR January last year. Once again they paid fees when she was already a Permanent Resident. Now my husband and I applied for a visa to visit my daughter and IRCC has requested an application to voluntarily renounce our PR. My question is, is there another option I have to enter Canada for a visit. It will take my husband and I at least a year to liquidate assets and wrap up our business in South Africa before we can move back to Canada permanently.

yes
you need a lawyer to keep your recidency
or
first you have to renounce,
then apply for a new permanent residency

Now that Canada has realized that you are a PR you can’t just relocate to Canada permanently. You’ll need to attempt to retain your PR via PRTD via H&C but given your longterm absence it will be quite difficult. Would suggest getting the help of an immigration lawyer in putting together your PRTD application for the best attempt at keeping your PR. If you can’t retain your PR you can visit but that won’t be permanent you’ll be expected to return home unless your daughter is lucky in enough to get selected to sponsor you.

Thank you so much for your responses. Looks like I will have to retain an attorney. Do you know how long it will take to to get get your PRTD via H&C and would cancelling my visitors visa application trigger IRCC to start the renunciation process?
