So at the time of application you were actually common-law but your mom put you as single family member. In that case, she should correct the necessary form, and send it to the visa office.
Else, you could wait to see if they actually compare and notice the difference between 2 apps, and then send in the update when they ask about it.

All i need to know is that it doesn't stop me from getting my PR and that it can be corrected. in case my mother didn't update her file.

Hi rob, suppose my mother doesnt update her file, can this be grounds of misrepresentation or it can easily be addressed? This is really bothering me.

you can chose between doing nothing or doing something...
If I were you I would contact immigration and explain the problem to them
and update the information...
you can call the CIC call centre @ 1 - 888 - 242 - 2100

It will not stop you or her from getting PR.

As Rob_TO said, CIC doesn't really care about non-dependent family members. The outcome of your mother's app will not be affected by you being listed as single instead of common-law, so I seriously doubt if CIC would ever see it as misrepresentation if it isn't corrected. There is almost no chance that CIC would ever even notice the discrepancy.

That said, the easiest thing to do would be to have your mother fill out, scan and email a new IMM5406 to her VO, explaining that she is clarifying your marital status as common-law instead of single.

yes i filled it out already its just to send it in to CIC, just a bit hesitant cause i dont want anyone to blame me for disrupting their application.
