Hi everyone,

I have a couple questions about sponsorship.

I am a Canadian citizen and I got married a couple months ago.
My wife is from Europe and she is here in Canada with me.
I was married before and i sponsored my ex wife from a other country too so I can't sponsor my wife because I have to wait 3 years after my ex wife got her permanent residence.
The 3 years are done by next year.
My question is if there is a other way to apply for a permanent residence.
 
If your wife qualifies for an economic stream (express entry), she can go for that.

Bear in mind, your second spousal application, as soon as possible after the first, may attract more scrutiny for genuine relationship than the first did.

She applied for a open work permit 3 months ago from inside Canada so she sended the documents and her passport to New York but it's still in process.

On what basis did she apply for the open work permit?
 
She is here as visitor and we applied for a open work permit so she can work here till I can sponsor her..

Ya it's still in process, and we extend her stay here in Canada, that's still in proces too, do you know what else I can do..

Yes, but on what basis did she apply? Does she have a Labour Market Impact Assessment? Is she 30/35 or under and from an IEC country? Is she a graduate of a Canadian university? Those sorts of people are allowed to apply for work permits. If she applied for a spousal open work permit, they're only available *after* you've filed an inland application (the two apps are normally sent off together).

Unless there are details you've left out, she doesn't qualify for an open work permit and the OWP application is going to be refused.

Okay, she doesn't have those things, but is there not any other way to stay here in Canada? Because is 22 years old and she haven't finish her school..

Expect the OWP refusal then. I believe it will be tough for her to qualify for other economic streams if she hasn't finished her school yet. Other option is to just wait until you can sponsor a spouse again.

She can keep trying to extend her status in Canada as a visitor and remain her without working or studying. Hard for any of us to say how long CIC will continue to allow her to stay.

She could try applying for a study permit. Although this is an expensive option and she'll need to demonstrate that she has at least $25K in the bank to fund her studies. She'll also need to make sure her planned studies in Canada make sense in light of her previous education and any work experience. Additionally, the application for a study permit can only be processed from outside of Canada.

Depending which country she's from, and IEC might be an option.
