My divorce petition has been rejected in Session court but I want to immigrate along with my daughter. Whose custody case is already pending in session court. So my question is if I apply in high court and the decision would be pending in High court then I would be eligible for immigration or Have to wait until the final decision.

Unless you have sole custody, you need your spouse's written consent to move your daughter to Canada. If you don't have sole custody at this time, I would hold off applying until you do.
