I am filling out right now the IMM5669 Background form. On the form is written: Have you, or, if you are the principal applicant, any of your family members listed in your application for pr ever: .....

so family members in my applications are my father, mother and sister, since there is no field to write down the sponsor (my husband) on the IMM5669 form, I`m not sure if that question counts also for him ? My husband had about 15 years ago a few `problems`, we ticked that of course on his sponsor form and in our cover letter we explained it, but I`m not sure, if we also write that down in the IMM5669. And one more question, does anybody of you know, what `Act of Parliament` is ? I googled it and I think my English is unfortunately not good enough to understand, what exactly that act is ? is it a political crime ?

many thanks in advance for all your help here, I would be lost without this forum !

For those questions, I believe "family" only refers to your parents and siblings. This is your background check, there will be a different check for the sponsor (your husband) included somewhere in the sponsorship forms.

An Act of Parliament (as far as I know) is when a bill is approved by the government and becomes a law. I'm assuming you're asking about Question 18 on the Application to Sponsor. It's asking if the sponsor has broken a law that resulted in them being charged with a crime that has a maximum punishment of ten years in prison.

thank you very much Kelsey,

yes, my husbands (my sponsor) form is the MM1344E, ok, so I don`t tick boxes for him in the IMM5669 form (as I assumed), since that is my background check.

as for the Act of Parliament, yes correct, I`m asking cause of Question 18 on Application to sponsor, I read on google about that Act of Parliament and also seen always the word `bill` associated with it. I don`t know how to shape that question since this field is clearly out of my education range, but I try: So as far as someone was not punished with ten (or more) years in prison its not declared as a `Act of Parliament` ? *sigh* that sounds complicated to me but its for sure not, its just that the dictionaries don`t know always every answer :) thank you again very much in advance.

When you read "Act of Parliament," think "Canadian law."

Exactly, thanks Majromax!

So you mentioned that your husband had some 'problems'. If he broke a law and was charged with anything, as long as his possible sentence was less than10 years in prison, you can select No for question 18.

No NO they still have to check that box ... it doesn't matter how long ago he was convicted.
Checking Yes is only for convictions where the possible punishment was 10 years in prison. If it was a minor infraction that was something like a fine or very small jail time, they should be able to check No, right?

From the form:
Have you been charged with an offence under an Act of Parliament punishable by a maximum term of imprisonment of at least 10 years?
Yes or No

So if the crime was not punishable by 10 years in prison, they can check No, right? I want to be sure that I'm not giving out false information!

A minor point, but when they say Act of Parliament, they're referring specifically to Canadian federal law. In other words, they don't want to know about your speeding ticket (provincial law) or that time you didn't cut the lawn so you got a fine (municipal law).
