IMM 5604 Declaration from Non-Accompanying Parent/Guardian for minors immigrating to Canada

CIC requested this form be filled out but I was wondering why when my son has full custody of his son with no actual visitation rights to the mother.

I was told if the mother doesn't have full visitation rights then there should be no need for this form to be filled out. Can anyone clarify this for me?

If the son is going through PR as his dependent and is going to get PR same time as the father, then it doesn't make sense for CIC to request that the form be filled out.

However if the son is not coming to Canada but will so later after the father lands as PR then the form needs to be filled out.

His son is coming here as his dependent and we even paid the fee for his son as well. I e-mailed CIC asking them why they needed this form when his son is coming here and that he has sole custody of his son.
