Hi, guys! I need some help, please!

My husband and I are applying for our PR and we got our application back today. He has a daughter in Brazil from his last marriage and when we completed our application, we filled the IMM 5406 form with our family information, and he included her in his form, as well as his parents and sister. However, we did not fill the IMM 0008 (Generic Application Form) for her because she is not living with us here, and she is not coming to join us in Canada any time soon, or even in the future, because she is minor age and she lives with her mother in Brazil.

Even so, the government is asking us to fill the IMM 0008 for her, and also send her birth certificate and two photos. Otherwise, we should send them a claim explaining why we can't provide those required papers.

We don't understand why we have to send an IMM 0008 for her if she is not applying for PR and when we she will not be here for our landing (when we get our PR).

Can someone help us?

This is normal and expected. It's required that she be included in the application since she is a minor and even though she is non-accompanying. This includes providing her identification information and completing the medical. If she is not included, this means she can never be sponsored in the future should anything ever happen to her mother. IRCC really dislikes excluding minor children from applications for this reason.

It's in the child's best interest that she be included in the application as expected by IRCC. You should do what you can to convince her mother to allow this to happen.

If this is not possible, then you will have to convince IRCC to allow the child to be excluded from the application. You will want to show that the mother has sole legal custody (awarded by the courts) and that your husband has no access to the child. You will also need to show that you have attempted to contact the mother to request her help to include the child in the application - and she has refused. You should expect this will increase the overall processing time of your application.

Thank you you very much! I totally agree that is a benefit for her. I hope we will convince her mother. She does not have her custody! It is only a matter of a complicated relationship between them.

So... you said that she will need to get the medical exams as well, right? That means she will also get a PR when we get ours? Because they are asking for her pictures and etc. I hope so! She deserves to have a chance here as well.

Other question: Should we fill a IMM 0008 form exclusively for her as well?
