I have a friend whose asylum application in the US is still pending for 3 years would like to go to Canada and to become a refugee in Canada. His 6 year son is American citizen. He was wondering whether his application in Canada would be adversely affected since his son is US citizen.
 
His son won’t be able to claim refugee status. Your friends claim will likely be denied as he has a pending claim in the US. Shopping for refugee status usually doesn’t end well for the applicant. Coming to Canada, even if eligible, he can expect to wait 2 years before hearing if his claim would be accepted. The wait isn’t much better here. After that, if accepted, it’s 32 months before you get a PR. He would also be unable to return to the US.

I believe if you have a family member in Canada, you’d be able to come to Canada as a refugee from the US.
