Hi,

I recently applied for ICT Visa and my company told me that the Immigration has said that I did not qualify for the ICT :o It was filed under the skilled worker category.

What could be the reason for me not qualifying for the ICT? The lawyer applied for LMIA Exempt in ICT, could this be the reason that the Immigration department want LMIA to be filed and then the transfer should happen? My company provided enough reasons and I am a quite critical employee for my company and the same was provided in the letter to the Immigration department. So not sure what could be the reason.

Can anyone please help.

Most likely CIC didn't feel you met the specialized knowledge requirement for the ICT. That's typically why they are refused. It's not enough for you to be a critical employee - your knowledge also has to be specialized.

Your question about the LMIA doesn't make sense. The whole point of the ICT visa is being able to come to Canada on a work permit without having to obtain an LMIA. If you need an LMIA, then you'd be applying for a regular work permit (not ICT).
