Hello,

Me and my family had our refugee claimant hearing 4 months ago. Until this day there is no decision notice. Checked few times with RPD. They said the member has not taken decision and it’s reserved. How long this can take? Any clue

There is no fixed timeline.

Is it ok to email them time to time to follow up? Or is it a bad thing. Last time I checked when I completed 3 months

You can email to follow-up but be reasonable with how many times you email them. You know the member is considering your case and it hasn’t been lost or that the NOD was sent but you and your lawyer never received it. Would suggest waiting another month and during your follow-up inquiry ask if there Is any further information needed that could help the member reach a decision. Was the minister involved in your case? Was the issue of IFA brought up in your hearing? Has your lawyer indicated a potential reason for the delay? What country see you from? Were you living in your home country before coming to Canada?
 
Yes the IFA came up but since I had the option to travel out to another country with my family I chose to leave. Pakistan is no good for my family since they are not the citizens of Pakistan. I do not have a legal representative post my hearing since his license expired after our hearing. I am direct with RPD ever since.
I came directly from Kuwait.
the minister was asked to join but he chose not to.
I did ask if anything is needed but the minister replied our case is complex and is of 2 different nationalities and he would review individually. He will reply in few weeks. That’s exactly he said 4 months ago.

It sounds like you know approximately why your case is taking so long. Assume if you have citizenship in Pakistan you could sponsor both your spouse and dependent children to also get citizenship in Pakistan. If your spouse has citizenship from another country your family may have also had the option to reside in another country. Was your family living in Pakistan longterm if are claiming that you were being persecuted in Pakistan? If you hadn’t been living in Pakistan it is harder to prove that your family’s life it ask risk if they return to any part of PakiStan.

Since there is no timeline for NOD and you have been told that your case is complex all you can do is wait. If it got to something ridiculous like years there are steps you can take.

This is a volunteer forum not associated with the government. If I was a lawyer why wouldn’t I be charging for the advice? The big issue with your case if the fact that you haven’t actually been living in Pakistan. How long did you visit Pakistan when you were threatened? Had you visited multiple areas of the country and large cities as well as more rural areas? Why couldn’t you continue living and working in Kuwait? Although I understand you wouldn’t qualify for citizenship you seem to have been living in Kuwait comfortably for a very long time without fear of persecution. There have been similar cases where families are really trying to secure Canadian citizenship because there is no guarantee that they can remain in whatever Middle Eastern country they live in for for life but have minimal ties to their home country. They could easily return to their life in the Middle East but that doesn’t provide longterm guarantees. In your case you should have really pursued economic immigration. This isn’t an obvious asylum case because you had a longterm home and established life where there was no fear of persecution. You appear to have travelled to Pakistan on vacation where you faced a threat and were able to return to the only home you have ever known in Kuwait where you are safe.
 
Sorry couldn’t reply earlier. It’s not the way you assumed or structured the narrative but thank you for sharing your perspective. If that was the case then the member would have rejected the case long ago.
