I'm applying for immigration under the humanitarian and compassionate considerations. In page 3 of the generic application, the dependents area, it says "You must provide the following details about each of your family members, whether they will be accompanying you to Canada or not. You must include your spouse or common-law partner, if applicable, and all of your dependent children, and those of your spouse or common-law partner, who are not already permanent residents or citizens of Canada." On the guide, it specifically notes that "You must list all family members in your application for permanent residence, whether they are accompanying you to Canada or not. You must also provide details on family members whose location is unknown (including those missing or presumed dead). If you don’t, you will not be able to sponsor family members at a later date if they are not listed on your application."

I have a spouse (adult) who is not accompanying me to Canada currently. He is not financially dependent on me.
1) Should I be including him as a dependent because it says to list all family members?
2) If I am to list him, which category would he be in for question 12 (see the guide about question 12 below)? He doesn't fit any of the categories given.

"QUESTION 12 From the list, select the type of dependant:

Type 1
The dependent is under the age of 19 and single (not married and not in a common-law relationship).
Type 2
The dependent is 19 years of age or older, has been financially dependent on a parent since before the age of 19 due to a physical or mental condition.

The following types of children are for applicants who started an immigration process before August 1st, 2014.

Type A
The dependant is under the age of 22 and single (not married and not in a common-law relationship).
Type B
The dependant has been continuously enrolled in and in attendance as a full‑time student at a post-secondary institution accredited by the relevant government authority and has depended substantially on the financial support of a parent either:
  • since before the age of 22, or
  • since marrying or entering into a common-law relationship (if it happened before the age of 22).
Type C
The dependant is 22 years of age or older, has depended substantially on the financial support of a parent since before the age of 22, and is unable to provide for himself or herself because of a medical condition."
